Down shift issue

hello
i have just rebuilt the transmission in in my 1998 zx9r C1 that had issues when i got it.

up shift is fine
down shift is the issue, when down shifting lever does not return high enough to select next gear. (if i do it by hand it works well)
could this be the pawl spring been worn out?
the selector shaft is straight and no signs of wear.
lever is not binding eaither
or what else can i check?
