Breakdown / Bike Lane Offences

Post by dave#3 »

Well, it was bound to happen sooner or later .... I managed to get myself booked for riding in the breakdown / bike lane on the Gore Hill Fwy yesterday morning. :(

Where I was booked seems to be signposted as a bike lane but the copper refered to it as a breakdown lane if this makes any difference.

I had heard / read / thought that the offence normally only carried a $$ penalty with no points. The ticket I received was for "Not drive within marked lane" which carries a $127 fine and 3 points.

Now as a P plater, three points is a BIG deal, so I am going to see what I can do about it, but I am interested to know if others have been booked for this same act and what they were booked with.

TY, I seem to remember you having been booked ? Jason ? Anybody else ?

Thanks,

Dave

I would have thought there'd be a more appropriate offence. I'll have a look when I go to work tomorrow and see what the offence would have been here. I suspect something along the lines of "Ride in emergency lane"???

I'll let you know.

Anyway, don't ride in the emergency lane. Do like I do and ride on the footpath.

I've been booked twice and pulled over about 5 times.
The first booking was 'Crossing unbroken white line' which was supposed to be $$ and points but the points were never deducted.
The second was 'Travelling in a bicycle lane' or somesuch which was only $$.
So who knows - you might be lucky.
I'd be keeping an eye on http://www.rta.nsw.gov.au/myrta/myrecords/index.html and see what happens with the points.

If you follow the link through to get the free demerit point report you'll get something like:
Demerit points report
You currently hold the following licence class(es):

Class C Unrestricted
Class R Unrestricted

You have a total of 1 demerit point(s) on your licence. Your last recorded offence was on 19 August 2002.

Both licence classes will be suspended if your total demerit points reach or exceed 12.

Thanks ty !

I have been to the RTA site before, but don't particularly want to wait and see if I get away without the points.

It is interesting to hear that "Travelling in a bicycle lane" was $$ only .. I think I will try to get it downgraded / upgraded / crossgraded to this as it seems more accurate and doesn't cost points :o

I will let you know how I get on ....

Just checked my fine book. (brought it home with me...)

The offence here is Riding in an Emergency Stopping lane and is $$'s and 3 points.

I guess you just need to pay it and hope you have points left.

Thanks Jason,

What about if it is not an emergency lane but is infact a bicycle lane ? Does this make any difference? I know I am grasping at straws but a technicality is still a technicality!

Thanks,

Dave

One of my mates had a copper signal him to slow down while he was inbetween car. The copper then told him to pull over to the emergency lane and fined him for overtaking on the left and using a currently occupied lane. $165 each fine and 3 points each.

not good........
