You don't have to claim, but if you at least notify your insurance then his insurance will at least know that you could claim.

our insurance will at least give you some legal advice and can advise on what is a fair settlement. Don't sign anything until you talk to them. Your insurance won't get narky or anything as you still aren't actually claiming, so they'd rather help you get a good settlement and provide a bit of advice. Just protect your own back a bit...

A sore point with me at the moment. It's not your fault, but you must inform your insurance company. In my case they refused me insurance because of it. ?? Your call mate. The problem is, if you don't, your in breach of your contract. You must inform them, If you don't, they can refuse payment of any future claim. :?

sorry to hear, RG, hope you get that sorted out quick. let me know how you go if you fix your muffler, mine is not urgent, but is pretty scratched up.

btw, I parked next to you at uni yesterday, thought of dropping you a note to meet up for a beer after school, but was in a hurry to get to my critique. next time? -J.

I've rang up my insurer(Swann), they said as far as they are concern, they do not need to know as long as I'm not claiming money from them.
Therefore it's not in the records for them.

The accessor from RACQ is coming to see my bike tmr morning.
What should I or should not say?

Say it was parked legally.
Say your mate squashed it.
Point out as much damage as you can and blame it on the accident.

(You won't get away with the mirror, that was clearly broken before you started!)

Give it a wash & polish first, just don't polish any scratches or that might hide them a little. That way the bike looks like it was in good nick before it got hit.

You can say anything you want just don't sign anything...but you can ask at the begining whether they are recording the conversation

Probably all they are going to do is check that the damage is consistent with the claim. The give away will be the car paint on the bike, and the bike paint on the car. I wouldn't wash or polish anything - leave it all there as evidence.

The accessor came around just now at 7:15am.

Took a pic of the whole bike, a pic of the rego.
Took down the engine number, year etc...

Didn't even bother to look at the details of the damages.
Accessor: 'How much did u pay for the bike?'
RG: 'About 3 grand'
Accessor: 'Well the repair quote is $2500, we may wan to write it off'
RG: 'What? Someone knocked over the bike, scratched the side and u wan write it off. I'll have no bike to ride.'
Accessor: 'We'll see how it goes, I have to check the market value of the bike'
RG: 'Do u guys go by the redbook?'
Accessor: 'Yes we do'
RG: 'Well, it's about $3.4k on the redbook'
Accessor: 'Oh it is? I'll have to check that out.'

Accessor: 'How many cylinder is it?'
RG: '2'
Accessor: 'Allright, that's all I need, I'll get in touch with u'
He left at 7:20am

The muffler will be ok if you keep it clean and put some metal polish on it every few weeks (according to the previous owner of my bike, mine got scratched last year and there is no rust). The pods really loog good after a polish. I use Meguiars Mirror Finish All Metal Polish.

Yep, if they offer $3400, I'll take it for sure.
But I don't think they'll offer me that kind of money... Why would they wanna pay out $3400 when they can pay $2500 for the repairs?

as said before, its not your insurance policy, so they cant force you to give them the bike for $. However they can be a pack of arseholes if they want to, but they seem to be going ok... so far.

i re-read this thread from beginning to end to see if there's anything i missed, and thus far i can't think of anything beyond pure speculation, i can only the balls in their court and we'll have to see what they want to do.

Good luck RG, i hope it doesn't get more painfull than this.
