down here in Vic you tick the go to court box and wait for the paperwork.

I think you need to face up to the fact that your fucked. If you disagree with both the alleged offences, being unsafe overtaking and unroadworthy rear tyre, then I suggest you elect to defend it in court and garner some legal advice. However, I have no doubts that fighting it on the fact of the officer getting a dose of dyslexia with your plate would gain anything other than pissing off the Magistrate. However, if you disagree with the unsafe overtake and the rear tyre, fight it. Go get the tyre looked at immediately by an authorised or credible independent party and get some legal advice about the lane split laws.

I still reckon yr fucked though...............................................................................and it's nothing to do with your infringement notice :)

I'd ignore it and wait and see if you receive a reminder notice in the mail. There's a good chance that he has put the wrong details on the ticket but the right number plate details in the computer system, which is what will generate the reminder notice, but if not, who knows if the ticket is tagged to you or not???

In Victoria if you contest a ticket (for any reason) and elect to go to court then police will cancel the ticket in anticipation and compile a brief of evidence for the Magistrate. This will include certificates/extracts from Vicroads detailing your vehicle and licence, and a statement from the nice police man or woman that talked to you on the day. If there are any concerns in regards to the rego then that same nice police man or woman will simply give evidence that they wrote the wrong rego on the ticket. Friend or foe I always give the same advice, talk to a solicitor. They're the ones that now how best to deal with the situation after the events have occurred.

$232 + $99 = $331 plus loss of points. 6 months down the track it is water under the bridge and you have moved on, although points take a little longer to get back

Solicitor to defend you at court is around $400 - $500 plus rooting around for months plus visit to court and then the risk of fine and loss of points will make you all bitter and twisted.

Sometimes is better to cop a hit and move on.

I agree........... wait for a reminder....
If you don't get one, then the guy with the other plate will, and then he will need dispute it.....
If you do get a reminder, then send them a short letter with a copy of the ticket and say, you received this in the mail but it's not you ??????

My comment is not about apathy it is about picking the right fight. You reckon you have camo cops etc because someone didn't defend a lane splitting ticket :?

It is easy to tell someone else to spend their money to fight something when you have nothing to lose, I am sure he would take it to the High Court if you were willing to pay the freight

Here is my advise for minor traffic you don't need a solicitor,i have defended myself on 3 occations 2 got thrown out and 1 was reduced.(yes I did them all)
Without looking into it too much I would go to court , wear the splitting if infact you were doing something illegal but dispute the tyre.You may get lucky as your statement to the court might go. Your hounor I am here defending myself on the basis that yes I may have infringed by lane spliiting and I am happy to cop that but the roadworthy charge was incorrect.I don't like wasting the courts time my time or the officers time but there is a principal involved here.

Hi,

The air head (she must have been blonde) in the 4WD waiting to turn right onto the Putty Rd wasted countless traffic gaps large enough to get a Kenny through the intersection (let alone her scum box 4WD. After 5 mins, I gave up in disgust, passed her on the left at 5kmh and propped in front of her before making a safe right turn.

A cop saw me and nabbed me a couple of clicks down the road. My excuse? She let so many major gaps go by, I was sure she'd broken down or run out of petrol! And his response? 'Sounds fair, but now that I've gone to the trouble of stopping you, I have to get you for something.'

He gave me a ticket for a bald back tyre, explaining that it was the cheapest ticket he had ($88?) and it would NOT cost me any points. But yes, he handed me a ticket when he stopped me.

Wow, :shock: :lol:

I will wait for the reminder and then pay it. I am not arsed to go to court to probably loose anyway.

Lets not forget I was lane splitting and my rear tyre not the best. Still bullshit but what is done is done. Plus he took a photo of the tyre, which probably has my rego on it. :x

Just disappointing that a fellow biker didn't just give me a warning.

Just wait for the reminder [if one comes] then steer your defense from there..
