Fines for car that was traded in

Post by laidback »

Seems that the new owner of my Liberty is having a field day. :(

I traded the car in at a Ford dealer in Sydney and it seems that they haven't transferred the rego so I have to keep going into town (45km each way) to get a stat dec witnessed.

Does anyone know what happens if I just ignore the fines. :?

Did you fill out the disposal slip and have it signed and hand it in at the registry? If so they shouldn't be sending you nothing...

Even so won't help, I have heard in the past of friends which have sold their car, filled out and handed in their half but because the other person hasn't they still keep getting the fines.

I have been in the auto trade all my life. It is the responsibility of the dealer to complete the transfer of the ownership within a certain period of time, which varies state by state. They are in breach of their dealer licence and are most likely to be fined for it. My first call would be to the dealer principal of the dealership to advise they are in breach and have cost you time and money and that you will request compensation if it is not dealt with immediately.

At the same time, take your contract of sale and the copy of the transfer paperwork you would have been given by the dealer, to the RTA and advise them of the situation.

If this does not gain immediate action from the dealer, also contact the relevant state licencing body for motor vehicle dealers. If this action does not gain traction, then make a complaint to fair trading.

These are the first courses of action.

If all this fails PM me and I will talk to you about what to do next...

If you have the contract of sale and the copy of the transfer documents, you cannot be held liable for the fines.

Umm. I to worked in the trade for 13 years in sales. The dealer should have the trade in transfered into there name before it is offered for retail sale (not for whole sale). The new owner should be able to do what ever they like and the fines should go to the dealer. Just ring the dealer and talk to the dealer prinipal.
I love my new ZX10. It scares the shit out of me.
