Police busted bashing hoon driver in Mansfield

VIDEO footage has revealed the ferocity of a police attack on a hoon driver who did burnouts in front of a town cop shop.
The images, captured by a dashboard camera in a police car, show an officer kicking and bashing the driver with a baton.

David Bray, 32, and his passenger, Ryan Boyd, 19, left smoking rubber outside Mansfield police station on May 2.

A court hearing was told police later stopped them on a back road and said: "Do you think you run this town? We do."

Senior Constables Paul Bell and David Farrell are then alleged to have attacked the men.

One was kicked and hit with the baton and the other was punched and slapped.

Sen-Constable Bell, who is suspended without pay, was found guilty in Wangaratta Magistrates' Court yesterday of charges including intentionally causing injury and unlawful assault.

He was given a 12-month supervised community-based order and told to perform 60 hours of unpaid community service.

Farrell, who resigned from the police force in October, pleaded guilty last month to intentionally causing injury and was put on a 12-month community-based order, without conviction.

Sen-Constable Bell's solicitor, Bernie Balmer, said the officers had been frustrated at the road antics of the men they intercepted.

"People will be in two camps." he said.

"Some will say they got their right whack; some will say people can't be treated like that. Out of frustration, they've acted the way they have."

Mr Balmer said one of the officers had previously been shot at, and they had attended road deaths and suicides.

Victoria Police declined to comment because of the 28-day appeal period available to Sen-Constable Bell.

It's nothing new. I've been on the receiving end of that type of thing previously. Unjustified too. Had me pegged for something which was not my doing and which I had no knowledge of. Rather than go find some evidence and charge me, they took a similar option as the Mansfield police. It's one reason I lack general respect for the police. While I realise it was an individual thing within a much larger organisation and shouldn't be representative of the entire force. However, once you've had your fingers burnt, it is difficult to put it back on the hotplate.

That's a natural consequence for you. They intentionally antagonise the police by deliberately doing a burnout right in front of the station and then wonder why the police get the shits with them. :roll:

Should be more old school policing like in the USA, as soon as they pull you over for doing silly things like [burnouts in front of the police station FFS] You should execpt to be flogged!!!!! ;)

I hear u, but... as stupid and as dumb as it was, by law their still not allowed to do what they did... thats against the law to assault someone, so with that in mind if slater and gordon get on this they will win, as they do most times.... i can see a hot new car coming for this guy... paid for by vicpol!!!!!!

I'm all for old school, but you can't have it both ways. In my yoof, if we did that, we would get the local plod giving us a good clip over the ears and ratting on us to our old man. No charges. These days, they want to belt you AND charge you. Choose one or the other, but you can't have both.

I still don't get how them taunting the plod by pulling a burnout is such a huge deal. They knew who it was. All they really had to do was go knock on his door at some ungodly hour. I can't see how a bashing with a baton is justifiable? A little bit of an over reaction. But, I also don;t think pulling a burnout is such a big deal either. doing 260kph past the cop shop might be, but a burnout FFS. Your doing 4kph!!! What are you going to do, give someone and Asthma attack!! :lol:
