Pinged on sunday...

Post by P4nza »

Well as the topic says i was caught by a camping cop with radar...

I was riding with a group of around 15 bikes heading through penrith, through to the mountains onto mt victoria and then home via bells line....

all that came to a halt when just 1 minute passed springwood on the great western hwy??? i think... we were all doing 80ks just cruising along and then a HWY car out of no where stopped the L plater at the back of the group ( i was in the middle), so we all pull over, about 4 bikes in front didnt notice and kept going...

police get out of car and says " i want to see the L plater and the P plater" im thinking WTF?! ... he asks "do u know the speed limit is 60 right"? i honestly had no clue, same with everyone else... but what pissed me off the most is that HE DID NOT FUCKING PICKUP ANYONE ELSE IN THE DAMN GROUP!!!!!!!!!!! we were all bunched together doing 80 and he pings me and the guy on his Ls... he had his Ls 1 month... 480km on the ninja250 aswell... and worst of all is what the cop said to the group "i caught the L plater and the P plater but i know most of u were doing around 75.".... im thinking WELL WTF MAN BOOK THEM ASWELL!!! FUCK!.... but the cop did explain after giving me the ticket, view my options on the back, basicly its 1.cop the fine, pay for it and stfu, 2. go online to SDRO.nsw.gov.au and apply for leniancy due to circumstances or error was made, 3. go to court, or 4. it wasnt u it was someone else.
.
So... i called up State debt recovery office and asked them for leniancy... they pretty much said ( summarised) fuck off if u dont have a 10 year clean record ur fucked...

the damage: $211 and 3 points... apaprently for L and red P platers... ANY speed fine 3 month suspension....^%$$@#^%$#%@%$@^#@     :x :x :x

i'd take it to court.

How can he accurately guage your speed withoiut picking up any other vehicles.

he can only get 1 of you. the rest is an estimation.

Fight it, get the others to witness you were in the middle of a pack of bikes, all spaced correctly and no one was speeding. Ask for proof, it was you! You should have asked for the evidence when he pulled you. It would have been very difficult to pin point the two of you, as Wattie said.

Dont stop !!

And dont talk to them, tell him your name etc but dont enter into an convo about the offence etc..

He has obviously issued the fine based on him thinking he has you no probs if it goes to court, mostly based on some things you may have said..

At the end of the day the lidar can only pick one object..but through the conversation he must feel he has you covered..

DOH!

Best thing is leave it until the last week to pay, then write a formal letter to sdro, they will ackowledge it but won't accept it BUT you'll get more time to pay and ride. In the mean time you could *try* to contact your local council member but I don't know what they would do in your circumstances. I heard a story of a guy who was on his L's went through a school zone and appealed to everywhere possible and somehow the points where added to his C license (gigity) but he still paid the fine.

You could also try taking it to court but if the magistrate feels your wasting the courts time you could get a bigger fine.
However I *think* now if it gets thrown out you dont get points as well as the fine where as before you would still get points.

OR

you could just say fuck it and buy a 1000cc with a number plate flipper and ride the fuck out of it everywhere  :P Not really...

Sorry to hear the bad news.

Know someone who's had legal advice on this point before, the fact is that they can argue an experienced officer knows enough to make the correct judgement and therefore he only needs to get one person in a group. Had some mates who were riding together and they both got done. Asked of a lawyer if the other could get off but was told not a chance. However, arguing about whether laser beem was adversley affected by bouncing around different riders??? Probably not, but it does constitute a non-standard operating environment, unless the lader model has been tested as accurate with respect to a closely grouped pack of riders... Of course, its up to YOU to PROVE the equipment is faulty. In all aspects of the law, the burden of proof is on the prosecutor, except in traffic law.
See here, young man,
From Walgett to the sea,
From Conroy's Gap to Castlereagh,
There's none can ride like me.

Agree ! Sorry to hear and a bit stunned. Thought the new move was to support L and P platers, not take em off the road :x

Sorry to hear P4nza,

I'm a few months off from getting my unrestricted license and I'm becoming paranoid with the rozza's to the point of not going on group rides until unrestricted. I dunno if its just me; but when the rozza's see groups of bikes with LAMS riders, they must be thinking krispy kremes has freebies going on and start smashing it like Homer.

Best of luck with the appeal.

Maybe they actually used the L plate and the P plates showing as their point of reference, hence why only pulled you two aside?

Speeding is like fishing
There a lot of fish in the sea but you can't catch them all at once :P :P :P :P :P
