Hope you get a better result that what looks like is going to happen Rooster...
Bogan wrote:Been there done that, had an acco that was my fault years ago. I wasn't insured and I was contacted directly by the insurance company and made an arrangement. I had to call in every month and they'd debit my credit card. Ended up making a deal to pay a lump sum that was about half what was owing after a considerable time on monthly payments.

Sounds to me like your beef is with the insurance company and their policies rather than the poor dude who wasn't paying attention and hit you by accident. If you have to be angry at someone make it the insurance company.

I had an accident at an uncontrolled intersection the was deemed to be my fault many years ago. (I still maintain that it wasn't my fault but shit happens)
I was not insured so I took out a loan and paid for the other guys repairs because that is the right thing to do.... You fuck it, you fix it.

Cheers,
Pete

Just for interest sake & if you get the opportunity ask the assessor about his trade back ground.

I am embarrassed for some of the assessors I have worked with.

Half of them have next to no trade experience & have learnt to be puppets for the insurance companies.

Ooops I had better stop at that, the bitter side of me is coming out.

All I can say is thank fuck I am getting out of that game. :kuda:

Yes and he made that choice - now it has come to light it was the wrong one, and Mr Insurance company will be the winner.

Always go agreed value, always.

If he was insured then the scenario would have been to claim against his insurance I would have achieved a better financial result as to the value of the bike and its being written off and would have been able to keep it as well and not be out of pocket for any excesses, this is what has been done in the past and currently happens when people are insured, they usually do not want to claim against their insurance because of high excess fees they have to pay or their premiums sky rocketing, but the party who suffered the damage, in this case me would achieve a far more satisfactory result, this would happen happen regardless of my cover as it their insurance is paying not mine, and yes I made a choice based on finance at the time and took market value but did not realise that in the case of w/off I would lose the bike, my thinking being it's mine they are wrting off because the repairs cost exceeds the value insured and nothing about it being a disposal or anything and I would have easily accepted it could not go back on the road as long as I had it to part out and therefor make up the financial gap, regardless I have a few good people helping one from here who know how the game is played so maybe just maybe it will not be too bad a result

Eric this just sucks mate, I cant understand ANYONE riding or driving without any kind of insurance, full or 3rd party. In fact its illegal mate cause on ya green slip it asked if your vehicle is insured... has to be to get green slip.

Pretty sure you will find that the only compolsary insurance is the Green Slip (3rd party Personal) Though if you dont have 3rd party property you are a fucking idiot! My 3rd party property for the bike was only $220 I think with NRMA, really nothing at all for the peace of mind that if I go sliding into a BMW/Mercedes/Expensive car im not as screwed

Frank wrote:A friend of mine was in a similar situatiion with his car, he had it for 2 weeks before some twit in a brand new car ran up the back of him, his insurance co with held his $2000 excess till the prick started to pay back my friends insurance co, took him 18 months to sort out.

At the end of it all though Eric your insurance co should be the one chasing up this cretin for the their money after paying you out, that what we pay premiums for, you still may have to wait till you get your excess back but it won't be as bad as not getting any money.

If your insurance co has ritten off your bike do to an accident that was someone elses fault you could try buying the wreck back to get your bits back, depends how much they want if it's worth it or not though, really you should get to keep the bike anyway, but thats another aguement.
i agree with frank ,my friend was hit in her car,the insurance company worked out she wasnt at fault because the other bloke change his story about the accident, they told her he wasnt insured but thats our problem to get the money and paid for her car to get fixed.

If the guy at fault has been charged can you go through Victims of Crime or similar? We have them in Vic, not sure about NSW though?
