Infringement notice to come - thank you you oxygen thief!!

I'm riding home along Mulgoa road in the right lane. Pass a silver Rav 4 with a blond chick driving and on the phone in the left lane. We're coming up to the set of lights where Quix is on the left just after the lights.

I move back into the left lane as the following set of lights has the BP (fuel stop for me). In front is an old Subaru Sportswagon and in front of her is a Mazda something. Lights turn red and I pull up behind Subaru. To my left is the bicycle lane then island.

Check my mirrors - here comes Rav4 lady - at pace. Has not noticed the traffic has stopped. Still on the phone. I'm thinking "she's going to hit me - I'm out of here" and swing left into the bicycle lane and move up to the front of the line. Next thing - big bang! She's his the Subaru who has then hit the Mazda thing. Put the kick stand down and go to see if everyone is ok - Subaru lady has a very sore neck, Mazda man is swearing like a sailor and blond chick from Rav4 is in tears.

Decided to wait for the cops to turn up and give a statement. Cops arrive and I go over to say I saw it happen. Office takes my statement (including the fact that Rav4 lady was on the phone etc) then asks why I was in the bicycle lane. Told him I moved into that spot when I realised that Rav4 wasn't going to stop and that if I hadn't I'd probably be dead.

FMD the prick says that I've just admitted to riding a motorcycle in the bicycle lane, that it's an offence to do so and that he will be issuing an infringement notice via mail!!!!!! Seriously???? I asked if he'd prefer me dead on the road rather than alive and giving a statement - doesn't matter apparently as I broke the law.

Rode straight to the local station and lodged a written complaint with the area commander.

Seriously if an infringement notice arrives I'll be taking this to court - what a joke! So freaking cranky right now.

Wayne if it does come in the mail " didn't you just relocate your bike to a safe area in order to avail assistance at an accident site" you were not actually riding in a deadly treadly lane, you merely repositioned your bike to a safe location....well thats my story & i'm sticking to it!!!

Write out as much as you can remember of what happened now so you've got a record and don't have to try to remember stuff later on. Then talk to someone like Mark Sternberg if the infringement turns up in the mail and get an idea of whether it's worth taking to court....I reckon it would be but he'd know for sure.

Hopefully with the complaint to the station they'll decide it isn't worth pursuing and not send anything.
