That would be the thing. You dont know who was riding it, and the rider does not know they committed an offence (not pulled over). So all you can do is nominate a dozen people it could have been with none of them knowing they are the one that did it.

You have a responsibility if you know they are going to commit an offence with it, such as leaving the keys with an unlicenced rider, but otherwise.... yeah in the end if they cant i.d. the rider you will cop it anyway. And too late, he already owned up to it. I would have too, I am too honest. :D

In victoria if a vehicle registered in your name is found commiting an offence and the police ask you who was driving you must assist to identify who the driver was, other wise the penalty can be up to 2 years loss of your licence and a massive fine.

It's basicly used for when people are either trying to avoid the fine by saying "it wasn't me, must've been someone else, couldn't tell you who" or if they are simply refusing to admit to who the driver at the time was.

Sounds like you came out of it quite well. As you said, cop it on the chin, learn, but just don't get caught next time.... :D

If your vehicle was involved in an offence, under victorian law, you must "Make reasonable enquiries" to determine who was driving. So, here is the scenario your honour.

There was a party at my place with over 50 people in attendance. It started out as just a couple of mates and it ended up with all these people I didn't know. At one point, one of my mates asked me to borrow the keys as he was going to go to the bottleshop for more beer. He apparently gave it to someone, who gave it to someone else and nobody can remember who actually took it. I have called every person who I knew who attended and none of them can remember who actually drove the car???

It's been done. A mate of mine is A Vic police officer and he lost this case on these grounds??? Power to the people!! :lol:

I didn't want to be too specific, i could've quoted directly from the penalty book but thought that "assist to identify" would have covered it (i probably should've thrown in an "attempt" in there too). :lol:
