Update,

Shoulder is not torn :kuda:
but it is still damaged, and no amount of physio will help with my particular injury, Its called Bursitis, which is inflammation of the bursa(id explain it, but im sure wikipedia will do better). Which will be a lingering injury, that will never fully go away.

on a negative note, Swann called today, to advise that the other guy is now disputing liability, so i have to wait for the police report, and witness reports, and then have to try and prove that it wasnt my fault (starting to feel more and more like generally shitting on the little guy, so much for insurance protecting you from financial hardship as a result of an accident, ill be out of pocket about $4000 if it continues this way), so it could be next year before i see anything from them.

Lawyer time i think... any recommendations?

As much as i hate to say this mate, but if you have any reason to think you could be in the wrong, even 1km/h over the limit, talk to a lawyer!!!

Sorry to hear about your insurance hassles, but isn't your insurance company fighting on your behalf ?

Man I know all about bursitis...I've had it since my hip replacement in June last year. They normally treat with injections but wont do that in case they introduce infection into the hip...sucks big time.

I have no reason to think that, in fact I was below 60 by all evidence and my memory of things, but what I think doesn't seem to matter, the police still haven't even spoken to me about the accident yet, nor have they investigated the speeding claims, and my insurance company seem to be of the opinion that they get paid anyway, so why bother.

Its the fact that this guy seems to care only about the fact that he will have to pay his excess, which he has to pay anyway as the police have deemed no fault at this point, so it doesn't benefit him one bit. Its simply that he seems to want to drag me through as much shit as he can.

Im more or less over the crap at this point. Im going to have a chat with the minister for JACS who I believe is in charge of the police. But at this point im not expecting to get my claim approved and paid until april or may next year, which will unfortunately come about 3 months too late for it to be of any use to me as im moving to Wales in may, and could have really used this money for the Visa application period.

on top of that, it is definately out of the question that i will be back on a bike before 2011 as i now cant even justify the money to get even a helmet.
