Witness details are very important, particularly if its a cop, then you are set, but it may end up in court if just your word vs his.....

Well I called that number, and he told me the best bet is to go and file a P4 report at the cop shop
He advised he was'nt going to create an incident report due to the same reasons.....
No damage to any property other than my bike.
No one injured.
He said that the NSW cops have a reputation for not giving a shit when it comes to investigating accidents.
All I can say is the bloke who was driving the car has called me 3 times since the accident, making sure I am OK etc, when he returned the rental car he advised them of what happened, and that he was at fault, they asked for my licence number to process the claim, so maybe it's going to come from their insurer, and not his CTP ???

Oh and thx for the well wishes, my shoulder is a bit stuck (Rotator cuff I think) but it's an aggravated injury from another time.
My arm copped something sharp trying to stab me through my leathers, got a funny lump but the swelling is going down

You can't file a P4 (major collision) report because it doesn't fit the criteria. It's a minor collision (P5). If PAL won't take the report go into your local station and get one of the station constables to take the P5 for you. It takes about 5 minutes to do, theres no reason they shouldn't do it.

A dent in your frame may not cause the Bike to be written off, i had a lowside on my ZX6 and the handle smacked into the frame causing a small dent. They just filled it and resprayed as it wasn't structural.

Depends on who you get at the cop shop........ most will tell you to ring PAL again, as it fits the criteria for PAL......... I would try PAL agian before going to the coppers. You might have got a lazy farker your first attempt.

Get a quote for repair of the bike ASAP. let the guy that was involved in the accident know how much it is as he may want to just write you a cheque instead of going through insurance with the rental company. As already mentioned the rental companies excess can be quite high if you don't pay to lower the excess when hiring the car. It will also affect his insurance rating so this may be another reason for him to just write a cheque if the amounts are similar. Good Luck.

Mate unfortunately, as in any job, you get sometimes get someone who doesn't give a fark and makes us all look bad. PAL are really picky about what they take, I don't know why. I've taken plenty of P5 (minor accident) reports that PAL have refused to take for unknown reasons. Normally we do refer people to PAL, as that is their job and it's just as easy for the person reporting to pick up the phone next to the counter and explain it to the operator than to explain it to me, wait while I write it all down then type it all out myself, its usually faster for them too. But that's all we do with P5's, take a report only. We don't investigate minor collisions.
For those who are interested the criteria are:
Major collision (P4) - Alcohol involved, one or more vehicles REQUIRE towing (not were towed, required to be towed. People often get signed up by tow truck operator for shitty panel damage only), someone injured or someone failed to exchange details. With injury it is to be an actual injury that requires treatment, not just a sore neck that you aren't going to see a doctor for or a bit of shock, soreness to chest from seatbelt etc.
Minor collision (P5) - Everything else!
Mate how badly were you injured? You said you might have damaged your rotator cuff, did you see someone about that because that can be quite serious. If you were injured then it really should be a P4 accident and the other boso get get a ticket. Up to you.

OK, once again thanks for the input guys, the bike is definitely now classified as a total loss, the claim is going though in the next week or so.
I lost the bloody green slip that came with the bike, at first I thought that the insurance company wasn't going to process because of it
Anyway, I will just lose out on the Green slip remainder refund, but I will cash in the rego leftovers, the bike was insured for over $5500.
The driver seems to have fully admitted fault, as nothing has come back onto me.
Lucky I was wearing my gear, with leather jacket, as I found a half baseball shaped lump on my right forearm when I got home and took my jacket off !!
Seems like something tried to stab my right arm when I came off, the leathers stopped me getting pierced, now I am bruised from elbow to wrist.
My left shoulder popped back in after a few days, I have full movement back, just sore in certain angles, a few concentrated exercises at the gym will fix that.
My boots got scuffed but will survive, my gloves wore through at the palms, and my Draggin jeans look sorry for themselves, reckon I should splash out on a couple of new clothing items
Shame I couldn't get the money sooner, as there is a nice green 2003 model ZX636 up for grabs on Ebay for $5500 with 32,000 kms..... Anyone else interested ??!!

The search for a replacement bike begins here ..... I was told by the insurance company that all sports (Race Replica) bikes are classified as Grade 6, from an RGV250 up to a ZX10, Gixxer thou etc .... The only thing affecting premium pricing is the value / year model of the bike.
Super Motards are classified as Grade 3, might be a hoot commuting with one of those ......

Oh dude thank goodness you got all the insurance and your ok good luck with the hunt, bike buying is always fun even better when you don't have to fork out for it. I am eating baked beans on toast for the next couple of years after bumble bee comes home on Wednesday, eeeks. Can't wait to see your new baby when you get her good luck.
