A motorcyclist ran into an elderly pedestrian and then tried to kick her away from his bike as she clung to it while he was attempting to flee, a court has been told.

Joan Stafford, 69, received massive head injuries when she was hit crossing Plenty Road, Preston on Easter Sunday.

Mark Maccar, 24, appeared in the Melbourne Magistrates Court today to apply for bail on four charges, including negligently causing serious injury and dangerous driving causing serious injury.

Ms Stafford remains in Royal Melbourne Hospital - responding only to pain stimulus - and if she died, more charges might be laid, Senior Constable Jamie Mitchell told the court

Prosecutor Diana Karamicov indicated bail would be opposed on the grounds that Maccar posed a flight risk, might tamper with evidence and could interfere with prosecution witnesses.

Maccar's lawyer, Serge Petrovich, asked if there were any markings on Ms Stafford's body to indicate she had been kicked. Senior Constable Mitchell replied that there were not.

Magistrate Charlie Rozencwajg told the prosecution it might need more evidence to support its claim that Maccar could interfere with witnesses.

The bail application is expected to continue tomorrow.

How do we know that Joan wasn't an alcohol or drug fuelled maniac who attempted to unseat the rider as a drunken prank, whereby the rider simply swerved to avoid her and continued on his way thinking ...''what a drunken banshee"?????? I'd like to see the result of this case!!! :?

This was not far from my house.
I coped a lot of shit over this.
I remember watching the CTV on the news thinking PHEW.....its not a REX..

Well i would like to know wat sort of bike he was riding and wat part of the bike she grabbed onto?
the indicators ?

plus i have hit a wallaby before and i know if u hit one of them u will farken come off no worries, a 69 year old lady would be about similar size (if she was a small lady), so for him not to fall off, must of been a pretty slow hit

this to me sounds like beat up bullshit, its generalised and its one of those stories where they dont need to put much information in except "Motorcyclist did something wrong and little old lady with the name joan "typical" was a victim"

k so 2 scenarios

1) he was going really fast and because it was so fast he didn't hit her directly, cause if he did he would have come out! So in this case he would have skimmed her. So she has been skimmed and decided she is gunna latch her self on... WHERE is she gunna grab ? the swing arm ?? The chain ? use her super sticky suction fingers ?

2) he was going at a very slow pace, so the women has had time to grab hold of the bike, she has latched on, why would she latch on in the first place and if she does, why is she holding on still and getting dragged along, plus if your just a normal rider, sitting in a normal riders position you dont have really all that much mobility to be ables to do bruce lee's on people.


mmmmmmmmmm so many factors!

I wonder if he "nearly" hit her.... and she grabbed the bike.... and he is yelling at her to let go.... she wont.... he starts to move the bike forward, she falls over.......

Seems believeable to me...

It would be almost impossible to grab anything on a bike at any speed above 20k and hold on......

and kicking would definitely be out....

Joan Stafford was critically injured when a motorbike hit her as she crossed Plenty Rd in Preston about noon on Easter Sunday.

Police have claimed in court that motorcyclist Mark Maccar, 24, kicked Ms Stafford off the front of his bike as she tried to hang on after he allegedly struck her at 80-85km/h in a 60km/h zone.
Seems pretty well... bullshit to me, traveling at 80km/h hitting a solid what at least 60Kg object head on and not crash, which happens to be a frail old lady with the strength and somehow amazing reaction to be able to grab onto the bike which just hit her at 80km/h and somehow hold on, meanwhile the super rider himself through all of this manages to have a mind so focused he just shrugs the entire situation aside and merely attempt to kick her off, continuing on his journey.

There is seriously a magistrate entertaining that as a non-fiction story?

exactly my point, she is either fucking wonder women, got tangled on the bike or just amazingly grabbed hold of the bike and had a seizure and couldn't let go!
what a fucking crock,
