Speeding madness leads to lengthy jail term

Dubbo motorists have been warned about the consequences of speeding, after a man was sent
to jail for travelling at 175 kilometres per hour in a 50km/h zone on his motorbike.

Gavin Boyd Rieschieck, 23, appeared before Magistrate Howard Hamilton in Dubbo local court yesterday and was sent to jail for eight months after he was caught speeding by police down Yarrandale Road in August this year.

Rieschieck - a clerk at the abattoir - told police he was “running late for work” as he rode his motorbike at speeds of 175 kilometres per hour at 6.30 in the morning.

Rieschieck’s solicitor said his client wasn’t “aware of the speed he was doing” and after passing a car, opened the throttle of his bike and sped down a long, straight stretch of the road near the racecourse.

Rieschieck’s solicitor told the court his client saw a vehicle approaching, but other than that there were no vehicles on the road at that time.

Described as a person of “good character” and committed to church, Rieschieck’s solicitor said his client was suitable for community service, aware that the court may impose a full-time custodial sentence and had completed a traffic offence program.

But in sentencing, Magistrate Hamilton sent a clear message to Rieschieck that it was “difficult to envisage a more serious disregard for the law than to ride a motorbike more than three times over the speed limit down Yarrandale Road”.

“Highway patrol said the potential danger was extremely high,” Magistrate Hamilton said.

Magistrate Hamilton took into consideration Rieschieck’s plea of guilty to the charge of driving a vehicle recklessly, furiously or at a speed or manner dangerous at the earliest convenience.

The court heard that Rieschieck had no prior convictions and a limited traffic record that involved one matter where he drove while unlicenced.

Magistrate Hamilton told the court in order to deter this kind of action in the future from Rieschieck and everyone else in the community, a jail sentence must apply.

“There is simply no reason for somebody to be on the road and ride a motorcycle at 175km/h in a 50km/h zone,” he said.

Rieschieck was convicted and sent to jail for eight months with a non-parole period of five months. He will be released in April next year and his licence has been disqualified for five years.

Rieschieck will be able to apply for his licence again in 2013.

They appealed and lost so he still gets his jail time but they reduced his disqualification from 5 years down to three.
So I think that bloke got off lightly. :shock:

i was gunna say too, 244km/h is that it ? why stop there ? 4 months, jesus that is harsh, excessive i know, why we are all fully aware of a performance bikes capabilitys, i think its these 'non-riders' that think that speed is so extreme on bikes. If only they had first hand experience how easy it is to get to that speed and stop again! But still 244 is too dam fast for the streets so i dont forgive him just pity his stupidity

Either way, he broke the law and hte judge thought that was fair! Guess best thing to do is obey the law and then there is no problem!

Getting away from the penalty side of things, Hillsborough Road is a goat track and he was lucky to reach 244 kph without coming unstuck. the magistrate Michael Morahan is also known locally as machine gun Morahan for his practice of heavy sentences with a fairly loud spray for the offender. An appeal should get the guilty party out of the can.

I am up the Central Coast at the moment and as this event was somewhat local, it was talked about today. One of the managers was saying how insane it was to ride a bike at that speed on the road! I didn't mean to, but I pissed myself laughing involuntarily! :oops: :lol: He asked me why I was laughing! I told him that it's not often I get on the bike and don;t hit at least that if not more!!! :lol: :lol: :lol: He thinks were mad!!! :lol: :lol:

True, but he was apparently on the bypass in the area of Hillsborough rd
I doubt if there was much traffic around at 12.30 am .
The Habitual drink drivers I've seen get off jail time is obscene.

Man, if something doesn't change I might have to move back to england and put up with rain every second day. The anti speeding shit in australia is utterly mental. 5forbidden.gif

Yes, because the "feel free to do whatever speed you want" shit that they have Britain is completely different to what we have here. :?

And on top of that, it makes perfect sense to me that you'd want to leave this great country of ours based entirely on your perception on the governments tough stance on speeding. :? (again)...
