Hi all,
Been a while since I have posted anything but this is really big news as far as I am concerned. It would seem that changes have been made to the QLD Legislation regarding "hooning", in particular the Police Powers and Responsibilities Act 2000 has had a few amendments regarding noise and mods that are about to be enforced as of 01.07.2008.
For instance, an offence against the Road Use Management Act involving wilfully starting a vehicle, or driving a vehicle, in a way that makes unnecessary noise or smoke. The key word here is noise. Until now in QLD it has been more or less overlooked that you have an after market can/pipe on your bike.
As of 01.07.2008 the QLD Police will be looking to take noisy "vehicles" off the road. There are a number of others things that should raise alarm bells like "fender eliminators" and so on. All now considered illegal modifications.
For details of the changes check out Section the Police Powers and Responsibilities Act 2000.
Quote from section 70:
References to motor vehicle includes motorbike
To remove any doubt, it is declared that—
(a) a reference in this chapter to a motor vehicle in relation
to a prescribed offence includes a reference to a
motorbike; and
(b) a reference in this chapter to a motor vehicle in relation
to a vehicle related offence includes a reference to a
motorbike.
I should mention if you can produce a engineering cert to say for instance your pipe doesn't exceed 92.4db or something like that, can't remember the exact noise limit, then you will be sweet but you need to carry that on you all the time in case they stop you.
Safe riding...

Mate they could always ping you for driving/riding in such a manner to cause unnecessary noise. I got done in the ol' esky for that one a few years back, no points and only a minor fine, so unless this has changed..?Z1000 wrote:...driving a vehicle, in a way that makes unnecessary noise or smoke... I put new pipes on the r1 last Sat and on Sunday had 2 bike cops behind me for 5mins at a time eyeballing me.
So what happens, you get pulled over, defected etc, pay a fine, stick the stock exhaust back on and go and get an inspection? & are you allowed to keep riding or is that it for the day?

Re: QLD Hooning Legislation Reviewed
I got done about 6 years ago for unnessesary noise, in the first 3 weeks of legislation, $240 and 2 points.
If you try the old "I'll put it back on after the inspection thing" read the part about repeat offenders.
This is a law that gives the coppers a right to fit anything into the anti hooning laws, and gives them the right to confiscate vehicles on second offence whether its yours or not.
No good can come of it.

I'm pretty sure the laws bout exhausts being above 94-95db have been in place in NSW for a couple of years now, actually probably more like nearly 5years I guess ?? (time fly's). And I guess at the end of the day, it comes down to you knowing whether the db level of your (pipe) bike is legal or not! And you are aware of the penalties if you do not meet those levels. Hey . . . . I'm not saying it doesn't suck, I'm just saying 'you know the rules'.
