Makes sense ..... any reason for the gas leak ....like poor seals used?

Yep, just down to a simple casting tolerance.... Seems to be more prone to happening with the silver bodies; whereas the gold and black bodies (shock top section being referred to as a body BTW) have been OK...

the stock shock in my zx9r had the same issue (leaking gas), was fixed with a rebuild tho and had no issue with it after that......I still have that shock as well if anyone wants to make me an offer on it, its done little use since the rebuild but being a 98-99 model i dare say the amount of other bikes it will fit is limited.

I've got an 05 ZX10 shock in my z1000, I had it put in but kept the stock Z spring as it was pretty perfect for my fat 125kg ass!!
The difference was amazing, now I've got to work on the fronts when I get some spare cash!
