Busted and ......

Post by ZXRobyn »

Hi All,
It's been sometime since I posted and have recently received your new website details, so here goes!!
I've gotta couple of questions, hoping you may be able to help me with???

Q1. I got done on way to GP - cop was hiding in the middle of the Hume Hwy and did me for 0-15Kms over. He stated that he clocked me at 130, and decided to only book me for the min. Issued fine for $79 and loss of 3points :x
There was another bike riding less than 5m away from me - for which I thought there was supposed to be no other vehicles nearby for reading to be accurate or valide???

Silly me didn't ask to see the gun reading OR ask if it had been calibrated - DOH! And I'm spew'n. Is it true they are not supposed to hide, or sit at hills etc etc???
a) Anyone had experience with fighting ticket..... your advice as to whether this is worth pursuing or do I have to cop it sweet??? would be much appreciated.

Q2. Whilst in Melb, bike got up near the red zone (she usually gets hot when riding in the city, but not that hot) and spilt quite a lot of coolant from the overflow??? Any ideas???

Cheers People!! ;)

Where on the Hume did you get done? In Victoria, or in NSW? The VIC cops are notorious for hiding in trees, behind Kombies, etc, while the NSW cops practically advertise where they'll be.

FWIW Robyn i've appealed against Vic speeding tickets but only camera based offences, if this was a radar then I think you're stuffed. Re the overheating, could be a number of things, open the radiator cap and have a look to see if coolant is oving when the bike is runing, if not then you have a stuffed water pump. Check your thermo fan is working, next step is radiator cap or thermostat, thermostat should open if dropped in boiling water, easy way to check that is pull it out.

Might be worth mentioning make and model of bike then you can get more specific pointers perhaps from those a little more tech savvy than me.

Bookham is a notorious spot for them to sit, and unless you can argue the toss about the proximity of the other bike, you will probably have to cop it sweet and be glad he lowered the infringement. Get legal advice from someone like Mark Sternberg at Lawstoppers if you want to check out your options.

for $79 & 3 points.... I'd just cop it sweet.... not worth the effort / expense of fighting it, unless of course they were your last three points......

As an aside Robyn, given that the Hume has speed cameras all over the place and they all measure distance over time, ie if you make it from one camera to another camera too early, then the camera will assume you wre speeding and take a photo. You wanna hope you don't have your photo in the mail too...

to the best of my limited knowledge, those PTP camera's are only installed on the Vic sections of the Hume ??

Set of 3 point to point from memory
1st one just after cooper st(epping turn off) and the last set just before the Broadford turn off heading out of Melbourne

Court fee is $70 so the only reason you would take it to court is to fight the points. If you have more then 3 points then maybe you should consider just paying the fine (however, if you choose to pay the fine, it is an admission of guilt).

I got done earlier in the year for running a red, obstructing my license plate (mod gone wrong) and not displaying P-plate (it fell off). Took it to court and pleaded guilty with an explanation. Because it was my first offence(s), and possibly because of the way I presented myself (wore a nice suit and remorseful) the judge let me off (dismissed the traffic infringements and fines), however, he made me pay 2 lots of court fees (i.e. $140) which I was more than happy to do :D .

If you were genuinely speeding and the cop was nice enough to decrease the infringement to the lowest one then maybe paying the fine is best. However, if you don't have 3 points to spare then seek legal advice from Mark Sternberg (from what I have heard, the best motorcycle lawyer. He rides himself)
