THE Tasmanian Motorcycle Council has slammed the "tiny" $350 fine given to a careless driver involved in a fatal collision with a motorcyclist.
Midway Point motorcyclist Raymond Knight, 39, died when he hit a car doing a three-point turn on Fingerpost Rd at Campania on May 20.

On Friday, Rex Godfrey, 65, of Carlton, pleaded guilty to a charge of driving without due care and attention.

A charge of causing death by negligent driving was dropped.

Magistrate Michael Hill imposed a $350 fine and suspended Mr Godfrey's licence for three months.

Later there were wild scenes outside the court as the victim's grief-stricken daughter shoved Mr Godfrey into a wall.

TMC president Shaun Lennard said the penalty did not adequately reflect the loss of a man's life.

"It's not what happened outside the court that should be the news story -- it's the injustice handed down to the family of Raymond Knight and all motorcycle riders inside the court," he said.

"Nobody expects to come over the crest of a hill in a 100km/h zone to find someone doing a three-point turn on the highway. It should be illegal to do that anyhow.

"I don't know exactly what was presented, but it seems that a guilty plea to the far less serious offence has avoided a prosecution for the appropriate one."

Mr Lennard said Mr Godfrey's carelessness had resulted in someone's death and the penalty should have been much higher.

"Magistrate Hill said the court could not ignore the fact that a death had resulted -- and then went for a tiny fine," he said.

Mr Lennard said the TMC would be asking Tasmania Police why the case had not been pursued with more vigour.

"This seems to reflect much of the approach to road safety in Tasmania. It's only speed, alcohol or drugs that makes you culpable," he said.

"But inattentiveness or making a stupid judgment about where to make a three-point turn isn't considered serious -- even when it results in an innocent person's death.

"The TMC has questions we will be asking Tasmania Police about this case -- predominantly around why the more serious charge was not pursued in court."

2 cases in vic about 2 years ago copped a $500 odd fine and no license suspension at all. It certianly should call for driver re-training if nothing else. We can fine the bloke $50,000 but realistically what does it solve? It doesn't bring the motorcyclist back, but, certinaly a life taken should call for a stiffer penalty than $350....
A good mate will bail you out of jail, a true mate will be sitting in the cell next to you saying "Damn, we fucked up!!!"

this the incident that happened on the Sunday of the YMF Loan ASC round that casued the sensationalistic headline in Monday mornings papers.

hope there is a retrial or appeal or summat, thats a joke

We had a nice front page pic of Ray's daughter smacking the guy into a concrete pillar outside the courthouse. :shock: Seems she was a bit upset too.
There really are some wombats driving cars in this state. They never stop to consider what might come over that crest or around that corner. Me, I assume it will be a B-double.

This is typical for this state I'm suprised they didn't charge the rider with something! The level of driver skill and training here in Tas is appaling :? You gotta ride like your invisible!

If the cops had charged the grieving daughter with assault she probably would have got a bigger fine. It's not that bikes are hard to see people just don't look I've had on old guy do a U-turn in front of our truck I pulled up mm's away from his passenger door some people just don't think.

Man i couldn't stop laughing when i saw that pic, until i realised why the ignorant prick was punched, i really am supirsed she managed to have enough restrain not really screw him up, don't think i would if somebody killed my dad. This guy really should've been slammed with jail time and the culpable driving causeing death charge. If you kill someone with a knife you get manslaughter, kill them with a car, you get a slap on the wrist :? And everybody who's said so far that tassie drivers are wombats/ deadbeats/ zombies/ morons are spot-on, i'm on a bright green/orange bike and they stilll don't see me :D

i got a bigger fine for DUI..and i didnt do ANY damage....

this pisses me off.... saying a blokes life is worth $350...sheeeet....

this guy should of got a LOT worse..if not prison, then a LONG suspension of license...$350 wouldnt even cover the funeral costs...

what a joke....

yea disgraceful... if it were the bike rider who killed the car driver, things would have been different!!

makes me sad :(

Wonder if he had to pay for the motorcycle ..... considering its his fault it was written off... at least his family would get that 10k ....

For those of you wondering at my morbid attention to finances.... funerals are expensive.... imagine if he left a wife and kids behind..... something to cover expenses at a time like that would come in very handy...

Only if you kill a motorcyclist TS, you kill a ped or pushbiker they still throw the book at you....
