Contesting a fine..my version...

Post by Neka79 »

ok so heres how it is..just out of Horsham young mr plod decides Neka's having too much fun so he gives him a fun ticket....

but lets go back a step...

Coming up the freeway near Ballarat, i go thru that speedo check station..so i figure ill check it out, being ive changed my gearing..so i cruise thru at 120kph indicated..and it reads 105kph... 5 min up the road theres another one..so i go thru at 130kp indicated..and i get 114kph shown....

so methinks "ill just poke along between 115-130kph indicated and ill be ok surely"...

go forward to horsham...cop says "how fast were ya goin"?

me- "after that speedo check thingy i just did, i was indicated on my speedo at 127kph which means im doin abt 115ish right" ??

cop-"nah mate got u at 129kph...those speedo check things are not accurate and just there to give u a guide"

me- well its nice to kno this NOW... isnt that the whole idea of a speedo check so that i can see if my speedo is accurate?? isnt this sum kind of false information given to me by that speedo check" ??

cop- " those things arent maintained and calibrated, u'll have to take that up with vic roads"

needless to say im a bit pissed off... i got a $285 fine for 129 in a 100zone (i thought it was a 110 zone) wen i thought i was doing abt 115kph..i got 4 points (tho we dunno if they will come over to my SA licence) which means i MAY lose my ticket again..but i am disq from driving in vic for 28 days (like i care).. so coupla questions...

1.is this entrapment?? or false and misleading info?? or fraudulent?? (if i lied to ppl like those speedo checks lie id be shot)

2.do the SA & vic ploice share info (i kno vic/nsw points dont carry across)

3.is it worth writing a letter or sumthin?? i dont wanna drop big $$ ...and i did admit i thought i was doin 115 in a 110 zone... there just gunna pin me for doing 115 in a 100 zone neway...

farking vic police...im probably lucky he didnt shoot me...

Why the hell did you tell him you were doing an indicated 127kph??

"Heres your ticket son." would be the next logical step for plod to take after you INFORMED him of your speed.

Yeah those things are a farken crock of shit...

If they aren't accurate they should be ripped down and unplugged, end of story..

You've got a speedo in your car, if it's unaccurate you don't need a speed detection advise to tell you something else that's inacurate..

I dunno who would look at it and no go owe.. I sit on 100 and it says 95, i guess if i do 105 i'm doing 100.. who wouldn't... 8 hour trip that's a 40k gain.

Good luck with it mate.

i didnt ..... well not until after i looked at the radar...

i said "well my indicated speed earlier thru the speedo tester was 125kph but i was only doing 110....so i thought i was doing abt 110" in which case he made the assumption i had INDICATED 127kph..i also said to him

"if u reckon im doing 129..and my speedo says sumthing like that, then ur radar isnt accurate cos ive changed the gearing which means my speedo reads well over"...

on the bright side..he had the breatho in his hand, and when he read my licence it says "0 alcohol" ..so he put it away... good thing...cos i was a bit worried after sunday night...

Don't know about all the other questions, but yes points carry over state to state (unless, on those odd occasions, you get lucky). Fingers crossed you get lucky

i know the speed detectors aren't accurate, but they're not 10+ km/h over or under.

when i use to see stace in ballarat i use to run the gps and see the difference between the road speed indicator, gps speed sensor and my speedo. All three read different values but i remember, the gps had 110km/h, the road speed indicator had 108km/h and my speedo was showing 115km/h.

some how i reckon the cops camera is farked. But good luck trying to prove that.

i dont think ponits move across boarders but they will chase u for the money.

hope it goes well for ya mate. its gotta suck.

that sucks.

My speedo isn't affected by my gearing change, but it IS affected by the taller rear tyre i have on there. Going from a 190/50 17 to a 190 55 17 now means that my speedo is 3% pessimistic. ie an indicated 100km/h will show 103km/h.

Speedo healer is your friend.

Good luck fighting it. Or do as Stace does and drop trou. The Man will probably thank you by using lube next time...

1. entrapment is being led into/encouraged to behave in a way that you normally wouldn't.
2. i reckon points carry across. you SURE vic/nsw don't carry?
3. you were speeding. they want your money. they will get it.
(for safety... its all about safety, remember)

sorry to be a phrophet of doom....
i've done this a thousand times and no-ones ever been hurt. much.

yea last time i got done in vic (02/03??) i was living in nsw and the points never carried....

my point is how many ppl trust that those speedo check devices are accurate..therefore if they get caught they dont think there doing the wrong thing... and i think THAT sucks...
