Entrapment

Post by dumber »

Riding home tonight and pulled up 2 a red light. a blue commodore that has been right of my ass 4 the past 5 mins moves into the lane next 2 me.
His (or her) windows were tinted and i couldnt see the driver. he/she was givving the car a couple of revs. i really wasnt in the mood 2 prove he/she has nothing so the light went green and they took off... and backoffed when they saw i wasnt playing the game. as it left i recognised the number plate... unmarked cop car!!!

my question is, is that shit legal??? :?:

im kinda pissed and want 2 send a nasty letter but id like 2 know if they are even allowed 2 do it
Hell is empty, the devils are all here

Did ya get a ticket?

I mean, no offence.... the whole entrapment thang...

If you are exceeding the speed limit.... well.... no offence but you deserve a ticket...

Dont get me wrong, I deserve a ticket most of the time..... but I am just saying... if yer busted, yer busted...

That said.... Try the whole entrapment excuse in court........

According to the legal dictionary (US) (sounds like it applies to you)
A person is 'entrapped' when he is induced or persuaded by law enforcement officers or their agents to commit a crime that he had no previous intent to commit; and the law as a matter of policy forbids conviction in such a case.

Just bear in mind that the term "entrapment" differs legally from country to country...
The world is round. It has no point.

Entrapment doent count in austrailia thats a us thing.

They can use whatever means are available to turn you into a criminal and obtain a pinch.

And if ya get booked its your own fault must have been doing something wrong. :D

In Queensland they have been known to push things up mountains with utes with video cameras and slow down to below the speedlimit near double lines so they can video you going over them.

But lucky you you did the right thing. 8)
If I rode my bike at the speed of light, what would happen when I switched on its headlights?

I kind of think the whole idea that a cop can bully you into doing something wrong - like tailgate you - is completely crap. There are enough morons doing that crap for real without cops doing it as well. One day it will end in tears when they do it to some psycho that carries a 12ga in the back seat...there will be a shift in policy and procedures rapidly thereafter...

It depends which state you are in. For example, in Qld there are NO entrapment laws. Cops trying to coax people into breaking the laws is just wrong because the reason for busting people is to stop them from doing dangerous sh.t - by coaxing people to break the law then they are deliberately risking everyone's life...just my opinion, you don't have to agree or like it! :?

i guess if you could prove that they coaxed you into breaking the law then you might be lucky and get off lightly in court, however if it's your word against theirs then your stuffed. life's shit and then you die.

my dad is a lawyer and i have asked him about this before... and it is completely illegal for police to try to force u into commiting a crime, if i was u i would take this to the station and report them for hassling u whilst drive, driving erratically, and racing!!! stupid fucking cops

If cops were tailgating me i would certainly make an official complaint in writing and go all the way to court as tailgating is illegal :D I did have some cop in a xr8 try to bait me in my xr8 but the joke reversed as i seen the small lights in the rear window so next set of lights i gave it a big rev and of he went, then when he slowed i came right up his but then backed of.He then pulled into a servo but i watched my mirror and he came straight out trying to get me for something  But suck shit to him i just gave him a big wave when he passed me :P

I had exactly the same last year. unmarked gave it loads at the lights, I didn't bite and saw the little red & blues in the window at the next set of lights. They really are dumb f*cks tho, it was persistantly raining at the time

I've heard they also see cars with for sale signs in the window and ring the number. If you answer, they bust you for using a mobile whilst driving.

It is entrapment in both cases, is illegal, just very hard to prove.
