finally got a cheque from my insurance for my bike which was writen off over 13 weeks ago :lol:

and why the fuck do i have to pay excess when it WAS NOT my fault? what a load of horse shit.

anyways, am looking for a new bike now :D

That is a damned good question.... I didnt think you had to..... He has to pay HIS insurance the excess....

Gosh thats a long time to wait.. usual they are settled within 14 days.
Thats the usual industry benchmark anyways. What matters caused the
delay in paying out?

In regards to excess paid, if you were deemed to be partially at fault
5% for example then you are liable to pay the excess. Its common place
for both parties to pay the excess if either both parties contributed to
incident happening, or involved insurers cannot agree as to who is at
fault.

Intead or dragging it to Court, its easier for them just to whack you with
the excess.

Your best bet is to contact your Claims officer & ask him/her for clarification.

Good news on the payout mate but I would definately be checking up on the excess, if I recall someone ran into the back of you while you were waiting to turn ?

The partially at fault thing (I think sometimes called contributory negligence) is a typical insurace scumbag trick, my gf got cleaned up by some idiot turning right across an intersection and their insurance co tried the same thing.

Glad to hear the cash came through, ins companys aren't real flash at handing money back. Took 3 months to get one to admit their client was at fault when he pulled out in front of me :shock:

If it was 100% not your fault, sometime you pay the excess when your insurance pays out and that gets reimbersed from the at fault party.

Doubt thats correct Mike.

Its irrelevant whether the Insurer pays you out or not; whether the claim
is worth $1000 or $100,000

If youre 100% not a fault, & they say you are, you are not charged an
excess.

The only Not-at-Fault type of incidents I can think of where an
excess is payable are for Non-Recoverable Incidents (where you are not
able to provide details of who caused damage)

eg.

Someone hitting ya in Shopping Centre & you dont know who caused
damage


I've never seen a Product Disclosure Statement or Policy Booklet which
states overwise.

Just had a quick browse thru AAMI's site & found a page which somewhat
reflects my previous post about when excess' apply (nothing about partial
at fault or both at faults).

I would logically presume its not noted bc whether you are partially or
wholly at fault, its one & the same. At fault is at fault whether its 50% or
100%

Or more to the point they work out what you paid for the policy+excess+what they got for the scrap- payout figure is what their loss is.

On the taxis some policys used to be $5000 with a $1200 excess and if your carwas worth 5000bucks being a old one it wasnt worth comprehensive cover .

Anyway if they sting you with the excess even if you wherent at fault it saves their bottom line and they will all tell ya there there to make a profit.

Hey if you got ramed up the ass and you where sitting at a stop sign(it was a while ago and i have lost the detail) kick up a stink and write a letter to a ombudsman i am sure there is one.

I have never had to chase a insurance company but i do know people that have for loss of income and they will sign the check on the courthouse steps no problem.
