Lawyers are guided devices; they have only minimal roving intelligence. They exist for the purpose of taking what you want to defend yourself with and packaging it in a way that causes the magistrate to find you not guilty.

In this case, what the lawyer needs to package is, "My bike won't go as fast as they say I was going. Now get me off."

6 pages I was going to read them all.

Only 2 places I know of with Dyno`s in NEwcastle are Greame Morris (Cameron Street Broadmeadow) and Bikecare (Rear of 146 park ave Kotara).

Just remember no licence doesnt stop you riding just stops you riding on the road :wink: Always track days if you can get there,heap of diffrent bikes there

Dude if i was you i would fight it. They have been wrong before! At least try if you end up with a lesser sentance it is still better than what you are currently facing. Some mags even have adds for legal representation from lewers that do acualy ride (even if they are Harleys).

he is just trying to know what his options are as he has been told he cant do home detention due to his employment in a licenced premisis.

he wants to know all his options so he can prepare himself and family for what may happen.

trust me he is looking into getting the bike dyno'd and legal issues.

he just doesnt want to be given a sentence and not know whats happening.
also alot of testing and interviewing needs to happen for HD, as it isnt just handed out, and these need to be completed and handed to the judge prior to scentencing, if they are ultimately required or not. the judge is unable to scentence HD to then find out he is not eligable.

Thanks Kels that has hit the nail rite on the head, dont get me wrong guys i am fighting it,ive already mentioned to my solicitor about my bike not being able to go that fast and what not, and he is looking into things aswell for me, but if things do go wrong and the dyno proof gets thrown out of court for some stupid reason ill have HD to fall back on instead of a full time Goal term... That isthe only reason im doing this stuff to see if i can still get HD

Could always get a stat. dec to accompany the dyno sheet stating that the bike has not been modified over the time period of the incident and up until the dyno ... i presume the lawyer will mention this to you if they think it'll help. Keep us updated as to what happens !

I think it would be relatively easy to prove that the bike even in highly modified form could not be capable of 180k's :lol: Imagine someone spending large on a set of hot cams, high comp pistons, titanium valves, knife edged crank and titanium race exhaust on a GPX250 :lol:

Fair enough, but our point is....

You are unlikely to get a jail term OR HD at all!!

I mean, scum bags that steal cars and break into homes don't get jail time or HD these days, so the chance of you getting it for speeding is next to nothing.

Unless you've been caught driving/riding whilst disqualified, speeding etc a heap in the past?

Nah bro.

Only had 3 in 18mths & all lasted less than a coupla mins. The last time,
6 of us were spread across 3 lanes doing standup wheelies when the pigs
appeared right behind us so this has been the only occassion a chase
has lasted longer than usual.
