Mate, I hate to be harsh, but you fucked up. You made an error of riding judgement. But you don't deserve to be charged for that! You do however deserve to be charged for being a wimp and calling the authorities when you had a few scratches!!! Grow some balls Ya big poof!! :kuda:

I would blame the road surface and mention the environment was unsafe and an accident was imminent.

Site poor maintenance from the local council / govt, this may take the focus off your lack of experience and focus more on the hippies who are supposed to maintain our roads!

I suffered a boken headlight in my car after driving on a road in Melbourne that was under reapir. Vic Roads told me to send them a quote on a new light and they wrote me a cheque because I told them the environment was UNSAFE and had caused the incident......

Unsafe is aword they hate hearing........

As everyone else has said Winson it sucks but unfortunately that's how it is. Any single vehicle accident is a neg driving at least. It's the one they use when they can't think of anything else. Unfortunately it seems that when you're learning the assumption is that you are expert enough not to ever make a mistake but you're not expert enough to be totally unrestricted or to be trusted with twelve points. Hypocracy? me thinks so..

Anyway, before the time for payment expires on the fine write a very polite letter to the Infringement processing bureau explaining the circumstances of your accident and..... not that I'm encouraging you to be dishonest (well yes i am) try and come up with some sort of mitigating circumstance eg irregularity on the road, crap surface, avoided an obstacle etc (not that any of that is really mitigating but give it a go). It will help here if you have a previous clean driving record. See how you go, at worst they'll say bad luck.

BTW - when my bike got hit, i rang the accident report hotline thing but they said i didn't need to report it because noone was under the influence of drugs/alcohol, the bike could be ridden and noone was injured although we have different circumstances. Personally i would have only called them if i was injured or another person (which would need insurance) was involved and then just reported it to the hotline. On the upside, atleast your not hurt!

Thanks guys, i think by now i understand how to deal with the coppers as well as how to be safe in the situation that got me this time.

of course i will write a letter to the authorities and hopefully will get away with it. Oh, just the insurance assessor today have informed me that I have lost my first lovely bike forever and they will replace it :D

To shez: Sorry to heard your accident to, just hope you will get your bike soon so we can go out for a ride together in the near future.

the real cause was stupidity
it looks to me like we got the same problem :) but got to work on that next time, and don't be stupid again loh

Wow, In fact the authorities still have left a window openned.

Today i have being searching IPB which, i believe, nowadays is called State Debt Recovery Office. and, Look What I found http://www.sdro.nsw.gov.au/lib/docs/misc/br_001.pdf
A guildelines to review traffic offences :kuda:

It clearly state the circumstances usable to possibly get away from your tickets :twisted: I think some of you guys might want to take a look at it.
I don't know if it is an old one though but just want you guys to know that i could actually blame my inexperience and probably stand a good chance to get the penalty off.

State Debt Recovery isn't the IPB, it's the group that chases people who don't pay their tickets in time.

....but be polite.

Take your ticket with a smile and a thank you then go talk to a lawyer when you get chance.

In my experience, if you arse off and no one else is involved...you're buggered...but you never know!

"Careless Driving" over here means "...not the actions of a prudent driver.." which just about covers anything not in the road code!

At least you were ok, thats the main thing.

Wow now ive seen everything... the "did you shit your pants" comment really reminded me those cops from that movie "Superbad" ...... glorious :? Its very normal to fall off the bike when your just starting, it even happens to the most experienced riders out there, you just dont fall off a car cause it has 4 wheels.
