Fwiw I reckon you want the bike back in the same nick it was before she backed into it, that she has no insurance is not your fault, that she backed into your bike is not your fault, why should you have to grin and bear it for her mistake?

Get 3 quotes for the bike to be restored as it was is my advice.

Now, how picky would you be if it was you? The driver was ok, did not run away and such and seems to be a hardworking, honest person. No insurance.I have minor scratches which may not be visible if I have a good rub. I don't have comprehensive insurance so all bills will be paid by her. I would definitely make her pay for the pegs, etc. But minor scratches ?

How would you guys deal with this situation ?

I just dont see why this lady should pay when he admits the bike isnt in pristine condition

The 3rd party in your green slip is not for the immediate property that you have damaged.
I have a guy at work who don't have insurance at all for his bike because he thinks that it is saving him the money and he has a good riding record. To cut a long story short a month ago his bike while parked on a hill rolled hit an oncoming car and cost him about $8000 plus no replacement bike. He was stupid enough not to have insurance and the way I see it is that the only way they will learn is by hitting them in the pocket and not yours. Be honest to the girl and to yourself. Don't sell yourself short because there is always a chance that the other party will do exactly what is not right.

Friend of mine was parked at Mt White, bike in 1st gear and leant over correctly on its sidestand on a downward slope. Anyhoo there was a big wind gust that blew the bike OVER and made it fall over on the other size onto a zrx250 causing about $1500 of damage to the plastics.

Anyhow i called the NRMA for legal advice for him, and they advised that as he took all precautions deemed reasonable and it was the wind that blew the bike over, he wouldn't be liable for the bike falling on the other bike.

So unfortunately for the person his bike hit & banged up a bit, he didn't pay for the damage (hey would you have forseen your bike falling over and doing that?).

But backing over someone elses bike entirely or kicking it over... That's another issue alltogether.

Javaman, can you clarify for me? I'm confused.

You say your bike has damaged pegs. You also say it has minor scratches that may or may not be fixed with a good rub. Were both these problems caused by the driver, or were the minor scratches pre-existing?

the rego and the TAC or whatever it's called is for cover injuries of ppl involved if they can't get up to work the next few days or weeks or so, not for any property damage, hence u need 3rd party to cover up someone else's car / bike in the accident.

i reckon this is also why we pay less Rego than cars simply because the chance of a bike would injury a pedestrian is much falr less unlikely than cars...........................

Get quotes from new pegs and professional removal of scratchs (if she caused them). Then get prices of pegs from breakers and try T-Cut or colour restorer and try and rub out 1 scratch.

You can now offer her 4 alternatives

1) New pegs from dealer and respray (if scratch won't polish out)
2) Breakers pegs and respray (if scratch won't polish out)
3) Breakers pegs and a bottle of T-Cut
4) New pegs and a bottle of T-Cut

You're being fair, showing you're willing to compromise as long as your bike is returned to its original state

In NSW you pay rego/ctp seperately and oftem your lookin at 400-600 bucks for ctp for a 301cc+ bike. unless you have a bunch of policies etc with the one provider (i.e. i have car ctp/comprehensive bike ctp/3rd party prop with the NRMA and get about 50% off on ctp because of it all).

Remember though as well, pillion passengers would claim against your CTP if they came off in an accident you caused.

My bike $388.20 (rego fee $32.90 TAC $323.00) Although the $50 levy is hidden in the TAC
My car $365.80 (rego fee $164.50 TAC $183)

My car is cheaper.
