this is going back a few pages but...
Regarding the whole comment on our lack of specifically constitutional rights, that is actually a good thing. Our human rights are based on common law which was originally based on Britains common law system. Our rights are protected by precedence, not a thousand and one ammendments to our constitution. Why is this good you ask?
because it means that human rights in most parts of australia are based on common sense and law, we dont have a constitutional right to free speach, but our right is protected by law instead. on top of that, it makes it much harder to deny someones rights because 'theyre not in the constitution and such dont exist' because if there is precedent then that right is protected, if there is not, then with correct representation and argument, then precedent can be set and the right created.
Dont go off half cocked assuming that just because we dont have a bunch of ammendments to our constitution that we dont have any rights, a very short study of common law will change your entire opinion of the legal system. and even if someone is arrested under these laws, it wouldnt be a far stretch to use common law to get it thrown out and potentially get the law repealed.

My intention was not to insult the Aussie laws and regulations as I believed that the form of government in the U.S. is fucked. I wish we had the laws and regulations that Great Britain has. I am not familiar with what the Aussie laws are. I do and do not like the law of the west. However in some cases it has saved my ass. All is not perfect, if it was I would be dead. I am very glad to hear the points of view from another country as it makes me realize that there really is intellegent life on earth, just not in the U.S.
