so i'll cut the story down was in an accident in my car with a car that didnt give way at an intersection, so i'm the not at fault driver.
however it wasnt till after this i found out my insurance was cancelled back in nov 2010. so my car is going through the at fault drivers insurance, and the cost of repair is a bit pricey so they are looking at writing it off, and they have put $5500 on it. i told them i'm firm at $6500 for it to be settled and i''ll be happy. When i found out the car was uninsured i put insurance on it and my insurance company have it valued at $6440. I have the insurance cert to prove thats what my insurance have it insured for.
So am i right to stick by my guns and tell them either fix it or pay up what its insured for?

Stick to your guns Phil, don't take any shit from them & keep the pressure on till they give you what you want

If you can hold out then hold out. In negotiations always start higher than what you are prepared to accept.

Also try the insurance obudsman, they are actually called the financial obudsman service (FOS) they should be able to offer you real advice link -
