Yeah that's shit Eric but you'd still go after him wouldn't you, or your insurance company would.

What's the point even though been charged with neg driving and agrees he was at fault it goes before a magistrate he agrees to the proper amount then says he gets to pay it off at $10 bucks a week.

Been there done that, had an acco that was my fault years ago. I wasn't insured and I was contacted directly by the insurance company and made an arrangement. I had to call in every month and they'd debit my credit card. Ended up making a deal to pay a lump sum that was about half what was owing after a considerable time on monthly payments.
Sounds to me like your beef is with the insurance company and their policies rather than the poor dude who wasn't paying attention and hit you by accident. If you have to be angry at someone make it the insurance company.
Best of luck.

Yeah it's a two way street though, I take responsibility for any damage I may cause by having all my vehicles comprehensively insured, yet you end up at the mercy of irresponsible cretins who when they cause damage couldn't care less cry poor me and get away with it, and yes I should have held out and made sure I had agreed value when the insurers changed and therfor share some of problem caused by having market value, but quite simply I am fed up with people who take no care and no resposibility, i.e. until thet recover from this idiot they will withold my excess from the amount they are paying me, it wasn't my fault yet I get penalised, everyone is entilted to their opinion on this one but I firmly believe it about time that we stopped playing nannas with people and went to making sure that those responsible paid their dues.

So, what is the value of an Ohlins & Kerker equipped ZRX then, I'd love MR Insurance company to tell me that.
Tip for all players - always have agree value and always list modifications on the poilicy and adjust as necessary. Thats why I got a fair price for the 9 (and could afford the zed and some mods)

A friend of mine was in a similar situatiion with his car, he had it for 2 weeks before some twit in a brand new car ran up the back of him, his insurance co with held his $2000 excess till the prick started to pay back my friends insurance co, took him 18 months to sort out.
At the end of it all though Eric your insurance co should be the one chasing up this cretin for the their money after paying you out, that what we pay premiums for, you still may have to wait till you get your excess back but it won't be as bad as not getting any money.
If your insurance co has ritten off your bike do to an accident that was someone elses fault you could try buying the wreck back to get your bits back, depends how much they want if it's worth it or not though, really you should get to keep the bike anyway, but thats another aguement.

Are they going to STAT it or Repairable?
Dapending who you are insured with you could cash settle less the salvage price & keep the bike.
If you have the original parts you are allowed to put them back on & they will come off the market value. If you leave them on they will(or should) work out the value of them at a 2nd hand price & add it to the market value.
I have been assessing for these pricks for a year now & PM'd you my number.
Give me a call if you need a hand.
I am leaving them next week & going back into the trade so I cant get in the shit for giving some advise.

As a guide, when I had the 9 written off the insurnace company rang and said I could by it off them if I wanted - for $4500

It was worth $3500 tops due to the fact it had 130K+ on the clock. I politefully declined their offer.
