crash knob fitting drama's..

Chris took his zx6 into a unnamed bike shop here in Brisbane to have his crash knobs fitted..
He picked it up after they were fitted, nothing was said at the time. The next morning I'm having a look at them in daylight, and the shop has scratched his fairings, quite obviously. I've rang him and he's organised to take it back for them to look at. They admitted responsibility, said they'd have the fairing repainted. On friday they said that they'd hope to have the bike back today, and btw somehow the fairing above the headlight had been broken, cracked right through and they had had it plastic welded and painted too. As you can imagine he's not real impressed, and went to see it today and the orange peel is really obvious on the fairing, so now (apparently) they're going to replace the panel, which I think they should have done in the first place..

We were going to go for a ride tomorrow, now he's playing golf :(

two reasons, 1) they've admitted liability and are agreeing to fix it, so there's no retribution really needed. 2) litigation, if they get named there's always the risk they come after the mad-Kaw family as Dave's the site owner and technically he is the "publisher". I've seen it happen twice before, and even if your in the right it still doesn't stop them suing for defamation and costing a shitload of money.

You can't sue for defamation if its contextual truth under section 26 of Defamation Act 2005. wooot Law exam in two weeks time!!!!!!!!

Not exactly, to fit them to the 09/10 zx6 you have to pull the fairings off, and it seems on this bike that the sides and front are one piece, which means mirror removal etc. The shop I took mine to had to read the manual to work out how to get them off (and they did a very good job btw :))

And Kevin and Seiko, like Mike said they're fixing it, and I'm not risking Madkaw getting in any trouble, doesn't matter if it's right, it's not worth the hassle.

I thought you could sue for anything. You may not win, due to section 26 in this case, but you can still sue and that will force the other party to defend themselves under that section, can't you? I guess I'm asking if even if it's obvious to all that you won't win, you still have the right to sue (and in turn cause a lot of expense and trouble to the other person)

TTC: I am amazed that they stuffed this up. On the other hand, anyone can make a mistake, and as long as they're apologetic and fix it properly and quickly, what more can you ask for? I'd just be stoked that they admitted fault and are fixing it - not every business would be so ethical and customer focused.

I think you did the right thing TTC. It may have been an honest mistake and they did not see the damage they had done..... it may not have. But giving a company a bad name over something they are trying to fix is not good for anyone, and especially not good putting it in writing somewhere that one day could bite back. You never know when the day will come when they might have something you need and nobody else has it. You know what they say about burning bridges. It would be different if they didnt want to fix it and told you where to go.

You get to see both sides of the coin in the auto industry. We have a customer that we did some work on his car. We noticed something unrelated to our job had an issue and we just verbally told him about it to be helpful. Six months later the thing broke and he is hitting up our insurance company to pay for it because we did not put it in writing on the invoice that we saw it. Do you know the end result... it makes us not want to be helpful anymore.
