I am a Penrithite and know the intersection well. Pass it multiple times daily. Quick thinking to save your ass BTW!

The best course of action IMHO, even if you do not receive the infringement notice, is to contact the NSW Ombudsman (look them up). They will talk to the police for you and if you dont end up with the officer involved giving you a personal apology I will be extremely surprised. I would also go back and take photos of the area to help keep your mind fresh of the smaller details of the intersection... like maybe the bicycle lane is not clearly signposted or marked in any way and is infact broken lines for most of the intersection. ;)

Well done on the road awareness & use of mirrors. This is why i always leave my bike in gear while at lights when there isn't anyone behind me.You can bail out quick if the need arises. With any luck it won't procede & eventhough you were doing the right thing, going to court is a pain in the arse.

Just be careful as this idiot may have all the shit fall on him because he is a dickhead and then he and his mates may sweat on you making a blue to square it up, just be careful.

I've spoken to a solicitor this morning and he's advised not to mention the officers name to anyone except in my written complaints - for this exact same reason. He's less concerned about the possibility of the infringement notice as he believes that would be thrown out of court if it ever reaches court. His main concern is that I'll now come under more scrutiny from the officer and his buddies. If this happens I'm to contact him immediately.

Since I've learned to drive (24 years ago) I've always stopped to either help or provide a statement - this has really made me question doing this :frown:

Wayne well done on being aware enough to avoid the collision. I think anyone would do the same thing to avoid being hit from another vehicle, I know that I would have done whatever it took to get out of the way.

Did the officer write down word for word your version of what happened? If he did it will quite clearly say in his notebook that you entered that lane after seeing that the vehicle behind you wasn't about to stop, thereby avoiding being the middle of a sandwich. With your complaint to the LAC hopefully a Supervisor has discussed your complaint with him and hopefully common sense will prevail. Failing that if you do get a ticket, from what you've described one would think that the Judge will have common sense and throw it out.

I think you would be hard pressed to worry about this. Police have better things to do then stake out one guy on a motorbike who is a law abiding citizen. If anyone thinks police do this then they either have a guilty conscience or are not law abiding and perhaps a touch of paranoia to go with it.

In any professesion or facet of life there are the minority that make very poor decisions and choose to use their authority as right or wrong with nothing in between rather than applying descretion when it is required. It's a shame that the minority who do get it wrong or make poor decisions are who most people look at to judge the majority who are doing a good job.

i'd call you "involved in the crash" so this bit surely applies? ...
it clearly says AT the scene, not nearby the scene, or around the corner from the scene.

what a moron.

(1) A driver involved in a crash must comply with this rule.
(2) The driver must stop at the scene of the crash and give the driver’s required particulars, within the required time and, if practicable, at the scene of the crash, to:
(a) any other driver (or that driver’s representative) involved in the crash, and
(b) any other person involved in the crash who is injured, or the person’s representative, and
(c) the owner of any property (including any vehicle) damaged in the crash (or the owner’s representative), unless, in the case of damage to a vehicle, the particulars are given to the driver of the vehicle (or the driver’s representative).

Don't think this would stand up in court because Wayne wasn't actually "involved' in the crash, he avoided it and would have been well within his rights to ride off, but he did the right thing and stayed to help out.

I would bet a million dollars if it was a bike cop or car in the same situation they probably wouldve taken the same action,hey its human instinct to try and survive.So if the poofters send the infringment notice take them to court and up the poofters and hopfully you will get a judge that has some common sense about how the real world works :o .Also a big thumbs up for sticking around and making sure everbody was ok 8)

In order for a penalty notice to stand under scrutiny from a Judge, it must be proven beyond all reasonable doubt that all the proofs of the offence were met by the Officer starting the legal process against you. As you can see by the reactions here, this will not happen, as there is large doubt that what you did was "ride" in the bicycle lane.

Seriously mate this would be case dismissed in front of any Judge, so i wouldn't worry about it, was he a probie or did he have a hook or two on his shoulder, along with his chip by the sounds of it.....

god, wat the fuck. That is totally outrageous and totally just blows my mind.

The fact they expected you to merely sit there and get squashed while some fucking tool rams another car..... No doubt if u went between the cars in the other diection you'd get done for "admitting to lane splitting"

There is absolutey NO possible way you will get hit with that.. All you did was merely drive forward to move out of the way of a collision to avoid being part of it as you would have come off the worst. Plus you where a witness to the bitch on the phone too..
