this raises an interesting point.....

"...If you are holding someone up..." , and yet, this person is "....doing the legal speed limit..."

So if the person in front of you is doing the limit.......how are they holding you up ? You are not supposed to be going faster than the legal limit, so all you need to do is the same speed as the person in front, and all is good.

They can only be holding you up, if you are breaking the law and speeding ?? In which case, of course you will want to get around their sorry arse at the earliest opportunity.... :lol: and continue on your merry way, at a speed higher than the limit. If you get booked doing so, then as Matt has done, cop it on the chin.

But - if the person is travelling slower than the legal limit - then you should be able to overtake them without breaking the limit ? It might just take a bit of time if they are doing 99kmh and you are doing 100kmh ! :shock: Of course this hardly ever works in practice, we all just belt past and slow down - and if you get sprung in the middle of this, then you may get booked or you may not. It always depends on how the copper exercises their discretion on the day.......and more often than not, this will be dictated by the *dickhead test* that cops apply to motorists as soon as they pull them over.

Pass the dickhead test, and you will probably get a reduction or even just a warning. Fail the test.....and you will get reamed.

Just to clarify, the stoooopid girl was doing like 85km/h on a shity little bum fuck Qld road. Every time i had a stretch to pass she'd gun it. pissed me off.

When i asked my in-car advisor i was told to pass. Just shit luck i suppose. Until then I'd only had one little ticket in over 6 years. As any of the old Vics can tell you, a very good effort for me.

Also, as i apparently passed the "Dick head test" the fine was knocked down before they new my co-pilot was a cop aswell. He pulled the fine to 113km, $130 and 1 point. My said adviser advised me that mobile cameras won't pull you over until you are atleast 13km over. It's refered to as the "premier's" 10%, plus the legislated 3 km allowance. So theoretically you won't get booked in a 100 zone for less than 113. If it was knocked down any more, there wouldn't have been a fine at all.

Anyway, fine paid. time to move on. I had to cook dinner mind you. :roll: I was looking at a pork pie recipe until i a clip over the ear.... :lol:

Current penalties for speeding

* Less than 13 kilometres per hour (km/h) over the speed limit:
A$133 + one demerit point.
* At least 13 km/h but not more than 20 km/h over the speed limit:
A$200 + three demerit points.
* More than 20 km/h but not more than 30 km/h over the speed limit:
A$333 + four demerit points.
* More than 30 km/h but not more than 40 km/h over the speed limit:
A$466 + six demerit points.
* More than 40 km/h over the speed limit:
A$933 + eight demerit points and six month suspension.

I could never understand this one. (and yes i lived in qld and got fined lots when i was a young reckless hoon)

Make it a suspension .. but don't take the points.. or just take the points as that's what they are there for.

on a clean licence, I would still have 4 points left to lose/gain(whichever way you wnat to look at it) .... so why am i being suspended?

it is patently ridiculous to still have 4 points available and yet have a licence suspended for 6 months !!!

You are meant to *earn* a friggin suspension, not get one straight up with one offence !!

If you are lucky enough to stand before a judge you will understand how this works. Firstly they suspend you then they say if you commit again (any offence) than good luck. Thats right read you a letter and say you are on a good behaviour bond but not in the normal sense, loose more points in the next 3 years and then you could be without a licence, oh by the way any demerit points mean SFA.

mate - I have stood before a judge maybe 8 or 10 times now, total traffic offences since 1980 now number in excess of 90 ! :shock: :oops: - nothing to be proud of mind you - but I am way across what happens in a court when presented with charges relating to speeding or associated traffic offences.... :kuda:

what is really disconcerting about representing yourself in court, is when the bailiff walks past you, stops, shows you the sheath of papers she is carrying......and whispers " are these all yours Mr Gosling ?" :lol: :lol:

I have truly lost count of the number of 3-month suspensions received over the years....there have been a lot. One period of 'Licence suspended at the discretion of the Court' - that was a beauty ! It took all my bush-lawyer talent to convince the beak to give me a licence after only 2 years on this particular suspension..... :P

I am just glad that things like AVO's, good behaviour bonds and restriction orders are not taken into account when defending traffic offences ! :twisted:
