Help with leagal matter.
Re: Help with leagal matter.
First things first I would not worry about it until you have it in the mail.
Now..... Yes most defiantly they can estimate and they don't need a gun. I was pulled over once, I asked to see the radar gun, as I wasn't doing that speed. We went to his car, he pushed a button on the gun and said "Opps sorry I just cleared it" I said well I wasn't doing that speed they said bad luck and booked me anyway.
I contested it, lost it and lost my licence for 4 months. The magistrate took their estimated speed that I was traveling not the radar gun. If there is only one police officer you might get lucky as you had a witness if there's two of them saying the same thing you haven't got much chance.
2nd yes they have 12months statue of limitations that they can send fines out for. Now they have said to me a few times you'll be getting the fine in the mail, but its never happened I think it's more of a trying to scare you to slow down tactic in 99% of situations.
I've only once heard of someone actually getting the fine.
Your situation I wouldn't be giving it a 2nd thought.

There were two cops both single stripe on there shirts. One was playing the tough guy, the [girl] was being quite friendly., & chatting about the bike & to my Mrs while the bad cop was doing all the checks..

Re: Help with leagal matter.
What Blackster wrote was spot on, yes they can estimate speed and yes they can send ticket in the mail.
Generally the estimated speed should be supported with more than just "i reckon he was doing XXX because I do." GD's are not the greatest at putting briefs together for traffic matters. If you think they are going to send you a ticket then go back to the area, measure the distances and time yourself, when numb nuts gets into court and tells the magistrate they observed you doing x speed for x time you can come back with measured facts and demonstrate that it was not the case.

I dont know if he'll send the ticket,[hoping not, as its a day off work & you have to hope the Madge isnt a bike hater, but its best to be prepaired.

I reckon you'll be fine and they won't send it out to you.
I wouldn't waste anymore energy on worrying about it. IF you get the fine then get all the info you need.

True Jonny.
I just dont know what its gonna be?? Could be some trumped up shit & being double points I might lose my lience. If it turn up I hope its soon so I can work out what to do. If he had have said my estimation was 95 in an 80 I would at least know. But I know nothing, or even what LAC he came from..

Re: Help with leagal matter.
Tricky one. I can't see how he could prove that you were speeding, or that his estimation of your speed is accurate. Mate it took balls to overtake in that situation!
How about rocking up to the police station he's based at and complaining about it???

Magistrates will always have an open ear if you present any sort of evidence which contradicts the *estimated* speed. It is all about credibility. If you can cast even the smallest doubt on the validity of the coppers estimate - you will walk out of court smiling.
This assumes of course that it even gets to court. If old mate just did a check on your licence and then came back within a minute or 2 - then he hasn't even had time to write down all the details in his notebook - which he needs to do in order to refer to the details later on if he really was going to send out a ticket in the mail.
Given the single-hook status - mate have a few drinks and a laugh - my bet is you are not going to see or hear anything more about this. I base this on an informed opinion gained over several decades of *exactly* the same thing being said to me by coppers for minor speeding indescretions

Wouldn't go barking before he recieves anything in the mail and if you do recieve it, I still wouldn't go if you plan on contesting it.
If contesting and also want to complain, you draw up a representation in writing outlining the facts and events. You send a copy via registered mail to the commander of the local area command and the person whom issued the fine. You can ask the fine to be reviewed.
If they dont respond then you use it towards them when you go to court.
Long gone are the days of going into the station and talking to the sergeant to get things sorted.

Re: Help with leagal matter.
dopey bugger has probably confused acceleration with speed like most drivers do. might need to do your math if it goes to court (and hope it adds up). gps log would be handy.

Re: Help with leagal matter.
All good ideas,
but I dont know his LAC is,
so Im in the dark about everything,
where they come from & what he is accusing me of,
all he said was you must have been doing 100..
I do think speed & accelaration is too different things. But I didnt gun it as I was passing a cop car, so I just indicated & slowly passed both him & the old codger that was causing the hold up..
Im hearing ya Gos, he was only in the car for about 2 minutes, & I could see he was on the 2 way radio.
Got out come to handed me my licance & said "you'll get a fine in the mail" & drove off.!!

I meant the copper confused speed an acceleration, not you. if you need to do the math let me know.

Re: Help with leagal matter.
Yep I got ya, its easy to do, & thanks for the offer, with luck it wont get that far.
All up, after I passed them, he was in sight for about 3 Ks as I wasnt pulling much ground on both of them because I
wasnt going that fast. Execpt for a few corners he would be able to see me & would have known I wasnt rushing off into the distance, after 3Ks he was only about 800m behind me. I could see him & the old boy in my rear views. Once there was room for him to pass the old bloke thats when he rushed up on me.
So that in itself tell the story I reckon

Leanne and I responded on the other forum so you know what we think about the situation. Most people around here know what Leanne does for a living so her advice carries a bit of credibility and Kwakked Up's advice is good too and will add strength to your case if the cop is arrogant enough to follow through with the ticket.

Re: Help with leagal matter.
Yeah mate, thanks to everyone for all advice given. It realy is nice when you know you have people that can help no matter what the situation..
It a waiting game from here I suppose? I drafting up a letter now , which does call into question his very bad approch to this. He hes having a bad day thats not my problem, dont go bouncing me!.
The Mrs & I will go for a drive back to where this all happend, with GPS & vidio in hand, & get a record of the whole seen. Just in case he does send so trumped up crap.
Its the not knowing that is upsetting. He could have told me what he was doing, Not just the parting words. "You get a fine in the mail" Which could be anything!
