Just in case it helps... If you have an unrestricted drivers and riders license then you actually rack up the demerit points on which ever license (veh) you were using at the time. So if you receive a demerit point suspension on your riders license, you can still drive and vice versa. If you receive a court suspension though it covers all your licenses....
Same situation for restricted licenses but you have fewer points to start with......

You have 1 licence. There are not seperate licences for cars, bikes, 6-tonne trucks etc......
This one licence has different classes catered for 'within' that licence - these can include a motor vehicle class, a motorcycle class, a light or medium-rigid vehicle class.....there are others as well.
The points you accrue are counted against 1 licence, not the seperate classes. Accrue points from any driving/riding infringement, the points are accrued against your 1 licence.
You may want to contact Mark Sternberg - he is the solictor who writes a legal advice column in RAPID - he is pretty good at this sort of stuff - worth a shot anyway.

but Gos, if on P's for the bike he only has 2 points say, because of the p's. and has a full car license (12 points) and loses 4 in the CAR, they wont suspend his bike licence and let him drive his car still.

i think so - if he has accrued 3 points so far, and loses 4 for this offence, then that is a total of 7 points accrued out of a possible 12.....
so no licence loss, regardless of the 'class' that the points are accrued against.
So with only 2 points available against the m/cycle class - if these points were accrued due to an offence on the bike, then the motorcycle 'class' would be suspended on his licence, and he could still drive a car.......pretty sure this is how it works in NSW.......

Hey, thanks guys.
So am I understanding it properly...
I lost 2 points for this fine whilst driving. My riders license only gives me 4. So if I lose another 2 points, be it on the bike or in the car, I lose my right to ride?
Or I still have 4 points for my riders license as I lost these 2 points driving? So this fine doesn't really affect my riders license at all?
Or did I just make it sound more confusing than it is?!

I'm going to go to the area, take some photos and go to my local MP.
Because I came out of a side street on to the Hwy in the middle of a school zone, I only passed the one sign which was <50m from the street I turned out of and by the looks of it on google maps, its partly obscured by a tree too! No road markings or flashing lights, I really didn't know I was in a school zone. Worth a shot anyway I guess.

You need to check with RTA, but I am almost 100% sure that these points will not have any bearing on the 4 points available to you for your P restrictions on the bike. This fine *should* not effect any of the points for your bike class on your licence at all........but a phone call to RTA will confirm this.clay wrote:Hey, thanks guys.

From the description of the area - I reckon you would have a better than even chance of beating this fine......it is pretty similiar to a lot of the stories that Sternberg has written in his advice column in RAPID. Good luck !
