Come for a look see Ringwood Magistrates Court Dec 8th, all welcome. Fucked if I know how it works, sent off my speeding ticket asking for it to be heard in court, a week later or so I get a letter saying the offence is withdrawn, and today I get a summons for it...

The asking for it to be heard in court did it's main job, I have points again now, but still going to fight it assuming I can't find that bloody letter, wish I was more organised sometimes..
A good mate will bail you out of jail, a true mate will be sitting in the cell next to you saying "Damn, we fucked up!!!"

Sounds to me like the expiation notice was withdrawn. They would then lay a charge under the ARR and summons you to court.

Aardy, can they do that?? Withdraw the ticket then later decide, nah, fuck it, lets take it to court after all? Seems a bit rough to me..

My intention is to rock up to court, show the Magi the letter saying the offense is withdrawn, get an apology from the cops cos they fucked up and pop a mono down the street as I go home :)

Whether that works out is another story, of course I gotta learn to pop a mono too :) Can I borrow your bike Steve? Mate, buddy, pal, you know i'll look after it, and not like it hasn;t kissed dirt before should the worst happen :)

I think its standard to withdraw the ticket when you contest it in court,so im thinking your defence is not much good.I would be concentrating on a full on defence of the event.Starting with getting your speedo gps tested from speedometer joint in ringwood.With this certification at least it looks to the judge your fair dinkum and really believe its a bullshit charge.If your lucky the prosicutor may offer a deal just before you go into court.especially if its a low speed ticket.If he asks are you still going ahead with your defence be possitive and sya yep sure am.Good luck :lol:

It's as Jase said, pretty sure that if you contest an infringement notice, they then withdraw the Infringement notice and then send you a summons to appear so as to contest. Hopefully that made sense. :roll:

oh and the withdrawl has nothing to do with your guilt or innocence or the strength of your case. It is a proceedural thingy.

Mate, I think your confused maybe..

Once you elect for it to be heard in court, the offence and points are withdrawn ONLY until the matter is heard in court for which you would normally recieve a summons, which you have. The fine has been withdrawn pending your court appearance.

They are two seperate bodies normally, the fining agency acts on the courts/police instruction, however cant impose a fine if the matter is still to be heard in court. If you are found guilty after the court appearance you fine will stand or be re-instated to use a correct terminology, by the court notifying the fining agency of the outcome and therefore them re-instating the fine.

The fining agency in NSW is called the Infringement Processing Bureau and then excalating to the State Debt Recovery Office if the fine is not paid within 21 days..

Sorry for the bad news mate, they have not decided to just let you off..

Seems the others have explained it for me. All pretty much spot on.

Oh, and good luck. It takes a monumental effort to get off a speeding ticket in court. I think the best you might hope for is to ask the magistrate to reduce the number of points you lose.

Best chance is to find a judge that hates his time being wasted by small traffic fines,and as previouslt stated negotiate with the prosicutor.It can be done i have done it twice.Once for a speed camera and once against a cop. ;)

ThaT would suit me fine, is a 1 point offense :) Withdraw the point and the fine and i'll be satisfied.
