Sorry to hear about the off Winson, glad to hear you were ok & walked away :D
As above lesson learnt do not involve anyone that does not need to be there. I hit a taxi in the city when I was a bike courier & the farker dragged me down to the local cop station thinking I was not covered etc & I got booked because of him :roll: The woman cop behind the counter even said why did you come down ..... now we have to charge you :twisted: The insurance could have been sorted without the cops being involved it seems ....................the paki taxi driver went straight on my hit list XXbazooka.gif & all his mates ;)

This is turning into a hijak sorry Winson, Ron I dont have to worry they abide by Darwins theroy, a while back I watched one try to drive off from a servo with the Gas hose still attached violent1.gif :lol:

When I reported my drop (in person), all the PW did was take the details and gave me an "incident number".... no mention of a Neg. Drive charge. Maybe the fact that the diesel spill was reported by a TT driver ? :lol:
I've spent over 40 years of my life riding bikes .... the rest of it, I wasted ..
If it's got wheels or tits, it's gonna give you trouble !

MMMMMM Ok it depends what you have said to the officer in your statement....

I have came off the bike up on the old road with a broken ankle ambo's called police came to the hospital for a statement and been charged with neg driving...... took it to court represented myself and have got off the charge.
But in saying that you can't just walk into court and say not guilty there are things that need to be put in place to get off.

Fred will vouch for this because he was there that day I came off the bike

Just as i heard, coppas never come for nothing but a ticket book in their hand.

So for me and all of other new bikers, Unless very necessary, never call coppas or ambul... :lol:

Anyway, I will try to write a letter.

I really appreciate for your advices mates. :kuda:

What happened to you and what did you say to the police?

When i required to describe the accident, i said my bike hit sth and lost control then i grab the brake which causes the accident.

You could allways let them know you hit gravel on the road..... any comment Fred?

About a month after my accident and my stay in Hospital, they turned up at my place and took a statement.

The sergeant and his lovely young blond officer, took one look at my leg, felt sorry for me and told me that i would not be charged.

About the gravel.... unfortunately you all voted for a system where only the rich can afford to fight the big boys on a matter like that :roll:

I hit uneven road surface which continued through the corner which un settled the bike lost the rear end of the bike, which landed on my left ankle hence broke my left ankle lucky i had all my ridding gear on or I would not have a foot today.

I was in the hospital when the officer came and got a statement off me, drugged up mind you on morphine.... The police can not use the statement in court if you are under the influence... If you had something before they took your statement try and contact the ambos who treated and use it as evidence in court. I also took pics of the road condition as evidence and had my friend who also had trouble through that corner but did not come off as a witness.
When you go to court you need get reference from people you know to state that your a law abiding citizen pay your taxes bla bla bla although it's better to get people as witnesses if you can.
you need to right up the seqence of events of the day why you where up there and so forth...
eg. On sunday I went up the the old pacific hwy to meet up with my friends from the forum and to brush up on my ridding skills as I'm a Learner on my bike. Meet the guys at the pie in the sky around 9am for a pie and coffee, after the coffee and good conversation we decided to go for a ride up calga we all stayed in formation as we head north up the OPH. We got the slab had another great chat for bout 30mins then decided to head home all the guys i rode with went the other direction I continued home by myself back down south. Bout half an hour into the ride when I was into a left hand turn I felt the front wheel loose out and panicked and grab a whole lot of front and rear brake which stood the bike up and colided with the wall bla bla..... I have been told now that was the wrong thing to do when your on a bike because the bike is un stable when this is done...
You could even go as far as you have booked into a advance rider training to help on you ridding.... WHICH IS PROBABLY BEST YOU SHOULD. TRY AND DO THE STAY UPRIGHT COURSE in my opinion ;) You can also take that as evidence..
because a bike is diferent to a car, your riding expirenced / ability may catch you out but does not mean your negligent.

Section 52A of the Crimes Act 1900 (NSW) creates the offences of dangerous driving causing death and dangerous driving causing grievous bodily harm. A person is guilty of these offences if they drive a vehicle causing the death/grievous bodily harm of another:i) under the influence of intoxicating liquor or drug;ii) at a speed dangerous to others; oriii) in a manner dangerous to others.

What does "driving in a manner dangerous" mean?
Driving in a manner dangerous means any driving that is in a real sense potentially dangerous to members of the public in the vicinity of the roadway that the driving takes place. The case of McBride imports a quality in the speed or manner of driving. The potential danger to property in the vicinity of that roadway would suffice to make the speed and/or manner dangerous.

I would suspect that they are taking the "well, he lost control, therefore he was neglegent and a danger to the public" approach. I'm not a laywer, but I suspect you would have to prove/say that it was the circumstances at fault (road surface / weather / mechanical problem) rather than an inability to ride the motorcycle safely...

Yeah they just want to be C*&%ts... probably because there has been alot of incedents up there lately....

No other party was hurt in the incident like mine so there no need for a ticket

with my incident I told the judge that when hit the uneven surface it was either to pick the bike and cross the other side of the road onto oncoming traffic or try and ride it out through the corner, I deciced to try and ride it out remember this a split second decision. If I had went onto the other side of the road I would probably saved it due to no actual on coming vehicles.

What I'm trying to say is that decision I made at the time made me crash but does not mean that I am negligent... inexperience is a contributer to the accident

so if you show that you are going to do a course to improve you skill so this does not happen again it will be in your favour

To OP, there is a bloke always advertising in Cycle Torque and probably AMCn that is a lawyer for motorcyclists and is based in Sydaney, be worth having a chat to him I reckon. Personally the time I met the mud bank in St Andrews I had coppers and ambo rock up, it cost me a pair of jeans after thte ambos cut em open but no ticket was issued (I blamed it on gravel, the real cause was stupidity).
A good mate will bail you out of jail, a true mate will be sitting in the cell next to you saying "Damn, we fucked up!!!"
