Help Pls! My Baby Is Out Of Action :(

I need some advice/help on making a claim through the council due to some of the dodgy roads up here.

Last night I was taking a nice leisurely ride up through the spit at about 40km/h trying to find a nice spot to chill out, when all of a sudden wham! The front wheel hits this pot hole followed by the rear wheel, followed by a mini tank slapper. It scared the living life out of me, so I pulled over to see if there was any damage by shining my phone light on the rim and forks but I couldn't see any damage. On the way home it felt a bit weird as in the front wheel was low on psi, which is no drama I can just pump it up tmw on the way out for a ride.

Fast-foward to this morning. Geared up ready to go on ride, ducked around the corner to the servo to put some air in the tyres, the front wheel was down to 27 psi from 35. I thought there is no way it could have pushed that much out, so upon closer inspection i find both side of the rim are bent, aswell the front left fork is busted with a slow leak of fork oil coming out.

I carefully rode down to the bike shops to get some quotes on the damage, so far pro kawasaki wants $1149.40 for a new front rim, fork seals, fork oil and labour. Team Homo are suppose to call me back this arvo with a quote.

Do I have any chance of claiming this off the council, I was thinking of taking the nice route first, and asking them to compensate me for the damage, if there is no outcome there then I will go and see a lawyer.

Any adivce or help on this would be greatly appreciated, thanks for your time :(

Get onto Kellett Frame Straighteners, he can probably straighten that rim.

Ring the appropriate council they will have a person who deals with this stuff. Get them to meet you at the Scene. They should also take photos & then get them to take photo's of your scoot.
I don't think you'll have a lot of Drama once their person sees how dangerous that fuggen hole is.

And yes you have absolutely every right to seek compensation and indeed should get it, you have photographic proof, there wre no signs warning of road works or a hist road or anything like that so go em a row.

Send the letter attached with copies of 3 quotes (believe that's the law) and ask they recompense you for the damage.

If no go then time to get on to some legal type ppl.
A good mate will bail you out of jail, a true mate will be sitting in the cell next to you saying "Damn, we fucked up!!!"

Should I go through my insurance company, ie let their lawyers deal with the council to recover costs et?

I'd let the insurance company know and perhaps ask the best way to proceed.

You should be able to get the rim rolled out, although if someone else is paying I'd be bleating about a replacement.

Well I just called a law firm, and they said its not worth going through them at $400/hour :shock: She said I would be best off going through my insurance company. So I will give AAMI a call and see what they say.

Well AAMI said there is nothing they can do, so I would have to pay my excess (which is $1100, because I'm under 25) which is basically the cost of the repairs.

Time to drop into the council and talk to someone I think.

don't tell the council that the lawyers are too exxy and watever just make out as if they are backing u up all the way and the council is going to lose if it goes further, just put the pressure onto them!!

Whilst the government and their various bodies have a responsibility to provide good roads, as users of the road, we also have the responsibility to do our best to avoid such obstacles.

However, that is a disgrace and the only way to avoid it is probably to take another road. :lol:

The hard part is proving that the council new about the damage to the road and have failed to take any action with regards to repairing it.

Matt, had a guy at work today exactly the same thing had happened, council are paying to get him new rims for his z1000.

I think he's coming back in tomorrow, I'll ask him how he went about it.

Out cruzing one night i hit a pothole and blew out two(car) tyres busted rims and needed a wheel alignment. Got onto the local council and they payed the total amount, i thought it would be a shit fight trying to get it fixed but it wasn't. At least you have pics to back it all up. Good Luck.
