The speed limit rule

Thu Dec 03, 2009 7:08 pm

Hey guys,
It's been about 13yrs since I had my L's for a car and that was in QLD where there was no speed limit put on learners.

I now have my motorcycle L's in NSW but work in the ACT, therefore travel there daily. My question is can I do 100km/hr in the ACT even though I have a NSW learners license and am obviously restricted to 80km/hr over the border?

Keiran.

From my understanding the speed limit isn't was is set on your licence but more by what the state governs for each licence, if NSW says 80km an hours for L's then that is what you have to do in NSW if in Canberra the speed is 100km and hour then that is what it is for your L's irrelevant which state you got your L's in.

It's the posted speed limit in the ACT, and the Maximum speed limit you can do in NSW is 80 km/h

there has already been a post about this here:

the gist of it is that you need to abide by the conditions of your licence... so that means 80kph... who knows how any given copper might interpret the law however...

Cheers guys. I saw the other thread but that was from over a year ago. I thought something may have changed since then.

I believe you must still travel at 80kph in the ACT on a NSW learner licence.

However, ACT police are pretty relaxed. As long as your not doing over 100kph I don't think they will care.

+1

I think it has to do with the lessor of the licence conditions and the States laws. As your licence conditions are that of an 80kph max, that applies in the ACT for you as it is lower than the speed limit rule.

The reverse is that for an ACT learner they have to stick to the 80 kph rule when outside the ACT, despite not having that limit imposed on their licence. The good news is that an ACT P's rider can do the speed limit in NSW and does not have to stick to the NSW restrictions as it becomes purely abouty licence conditions.

I think the previous thread on this matter, and my posts within that thread, explain everything.

This is from the NSW Road Transport Act:
(1) The Authority must, in accordance with the regulations, recognise:
(a) driver licences issued by another jurisdiction, and
(b) licence conditions that apply to those licences, other than conditions that apply only in circumstances that are unique to that other jurisdiction or that are prescribed by the regulations.
