I saw an R1 in Yagoona a while back. The bloke riding was in regular leathers and wearing a backpack. The giveaways were the magnetic aerial base on the pillion seat (don't know how they attached it) and the fully marked BMW following not far brhind him. I thought they probably used the R1 to egg blokes on at the lights then have the Bimmer pull them down the road. Could that be entrapment :?:

You could call it that, but since Australia doesn't have laws regarding the use of entrapment by Police, what are you going to do about it?

Then its a case of finding a high profile lawyer (notice I didn't say a good lawyer because there aren't any) and take it to court.

If I were you, i'd spend the money on a cheap shitty lawyer, at least that way, when you blow your money, you wont lose as much!

Yep, in my experience the more you pay the more you get away with, it should't be like that but it is. 8)

Jase, isnt it up to the judges discretion?

Judges are solicitors who are voted to the bench by their peers, they havta drink and dine with their fellow associates so find a solicitor or barrister who dines with them and ya all right.

OK, here's the deal. (And I am speaking solely from a traffic offence point of view!)

1) We do not have entrapment laws.
2) Traffic offences are what we refer to as absolute offences. There is NO excuse for committing them. (There are exception but I wont go into that.)
3) To disprove you comitted a traffic offence would requie a lot of work on your behalf. You'd need several independant witnesses. Generally, the court will take the coppers evidence as fact.
4) Police are exempt from nerly all traffic offences under Section 305 of the ARR.

I'm not saying don't fight it... i'm just suggesting that you might be blowing your money.
