Hi guys been a while,

just wanting to let everyone know in the rouse hill area that if they would like to eat a place which does not pay their dues or respect tradespeople that this joint is ontop of that list.

The Project Manager went “bust”, So broke he opened up a new company in the same office space with the same staff and will continue to do his previous works under a new name.

A few things to take into account:

1) the owner of the restaurant and project manager are friends (smells fishy to me pitty it’s a pizza joint and not a fish and chip shop!)

2) the restaurants owner has not paid the project manager in full and does not want to pay the subcontractors at least what is owing ( in other words he knows what he owes but because he know the project manager he can be sneak and try and get away without paying) 1 + 1 = screw the subbies?

2) the builder being Celect Interiors and none of their sub contractors (IE ME) have been paid

3) the restaurant is fully functional, was built as per specification.

We all pitched in working ridiculous hours. Coming back for additional works to put finishing touches not in original contracts between 4am and 9am and then morning after morning until the owner was “happy”. Taking what should have been months of works into 5 or so weeks.

5 months on and it is us that are going without. We aren’t multi-million dollar corporations. We are small contractors, this kind gentleman owes my business close to $30 000 and the parent builders bill is close to $270 000. Forget about making a profit, we are talking wages that I’ve paid my boys and materials that are on his walls right now for free.

We cannot take the project management firm to court because they have gone “bankrupt” , we can however get someone to investigate and eventually people will see that yes he has money but in other assets unknown and worms his way out of paying decent hard working people.

So feel free to put in your 2 cents.. Im not having a whinge, it would be nice if they paid atleast what we are out of pocket for. And when Karma bites them in the backside one day we will all sit back and know why.. Its not too late to make things right. I just want to let people know in the area think twice about which businesses DESERVE your business!

Anyone know any good contacts from ACA lol
James

Simple, go into the restaurant and remove any good that have not been paid for. Refuse to return them until he has paid, and add an addition fee for the refitting - throw in the dismantle for free

Worst part of this sort of thing is once you spend your own money and buy something , install it at someone elses place it is effectivly theirs even if they dont pay you for it . :x :x :x
Then it costs more to take legal action . No wonder tradies walk away angry .
Rapid set concrete in the sewer outlet ! Difficult to repair

Not if you have conditions of sale on the back of your quote & Invoice stating that the property remains yours until paid for. If he is trading, rock up with some mates middle of lunch time rush & start dismantling the joint

What you want is a decent Romalpa clause. Beware though not all Romalpa clauses do the job. You need to make sure yours gives you the right to enter and remove goods. You also get in strife where your goods form part of a bigger assembly.

Good luck though.
