'Hoon', 43, loses car forever
April 4, 2007 - 7:40AM The Age

A Victorian man has become the first driver to permanently lose his car under the state's anti-hoon laws.

In a hearing at the Castlemaine Magistrates Court yesterday, Terrence Lord, from the central Victorian town of Drummond, was ordered to forfeit his blue 1980 Toyota Corona fastback. :shock:

Lord, 43, pleaded guilty to four counts of driving while disqualified between January 23 and February 14 this year.

Under laws introduced in July last year, drivers caught drag racing, doing burnouts or committing other "hoon" acts such as reckless speeding and driving while disqualified, can have their cars impounded for 48 hours for a first offence.

They face a three-month impound order for a second offence and the permanent confiscation of their car for a third offence.

Not so fast to condemn here please as there may be more to this than meets the eye.

Now if they have the same draconian points laws in Vic as we have in NSW then this guy may have lost his licence for being 10k over on four occasions within a three year period and he may have needed too drive given that he lives in Drummond (wherever that is) so what is he to do?

I 'heard' of a tradesman who had to drive for three years after a savaging in a local court where the only other offence against the guy was from 1973 which led to a "You'll not learn" type speech from the bench and the subsequent stiff penalty so think that he probably has no public transport available and needs to get to work to feed his family or even just himself,transport is a necessity after all.

I'd also point out that he may have been driving un-licenced but he wasn't drunk as well and the car wasn't mentioned as being unregistered either so it could be a valid,essential to survival thing,just saying.

Now if you were aware that your actions could result in the total loss of your vehicle would you take the 12?

well then, make that "absolute NUMPTY for getting caught". Seriously though, there's almost always ways around things like this, if your a delivery driver, try and cop a stint working in the warehouse while your suspension rolls on. If you a tradie working with an apprentice, get the probie with his P's license to do the driving to/from the jobs.

Or like me if you only drive for the convenience, HTFU and take the bus :-\.

pretty much describes permanent probation for everyone. :x :evil:

These new hoon laws are a summons type offence where the court / issuing officer generaly places an order stating that the vehicle in which the offence is committed must not be sold prior to the court hearing. Or sumfink like that.

So you lie and backdate the sale to a date before you received the summons. If there's something in the statute about the proceeds of the sale being forfeit, "Sorry. I pissed it up the wall down the pub and the knocking shop next door that very night."

i had a mate whos ex wife was trying to get his brand new (then- 99ish) WRX in the settlement... he "sold it to a mate" for $500...went to the pub and got shitfaced..and kept reciepts (dinner, takeaways ) and got staff to witness him feed $$ into a pokie and drink copious amounts...got thrown out, had the cops question him and all...and it was ALL recorded...lol
