mikk wrote:i got a hole in my radiator once because some council roadworkers shoveled hotmix and stones into the middle of a main road when the lights went red. this was in the middle of traffic and there was no signage or any kind of real warning that i was about to drive over roadworks. all that crap flung up into my radiator and next thing i know there is a cloud of steam coming out from under my dash

anyway, i'd say that's a case of it really being the council's fault. i got another radiator for $50, so that plus the pain in the ass trip home, the trip to pick up the radiator, installing it, getting new coolant, and cleaning the shit off my bike wasn't so bad. in the end i cbf going to all the effort to get compensated by the council.

as for the hard hat, well u rode into it when it was easily avoidable... sure u want money, but it will have to come out of your own pocket in this case. the damage was really minor anyway, just live with it :D

fuck you mikk! hahaha

But having said that... they will normally pay if you have a decent case. Just havta wait till ya grandchildren are due for their pensions to recoup the money...

Sorry to hear about the bike and good to hear you are ok, but fuck me, how the hell did ya not see a fuckin hard hat?

Cheers

Tape, we have an insurer & legal firm, you make a claim about x happened at x location, they send the location & details of the alleged incident to us, we go out & take photo's & give them info about what the road condition is like, if it's due for resurfacing, if there was any works in progress at the time etc. So we basically do the leg work for them & in return we get a cheaper premium. we then send it back with our OPINION only. It's then up to them based on the info given to decide if they will pay, NOT US!!! like you said, if we are at fault, they don't have a problem paying & it is usually pretty quick. I feel for chill cause hey I've been there & no one likes having a fucked bike........trust me I'm still going through the processes of a 15 fuken month crash repair that still ain't finished, but the reason i have insurance is in case I fuk up. In my crash I was to busy waving thanks & looking in my mirror to sum1 for lettin me pass, that when i got to the corner I went wide while using a bit of trailing brake & the rear touched the white line slipped then grip & started to highside me. Istood it up so i didn't get thrown, washed off as much speed as i could & said "geez that grassy spoon drain looks pretty good" Am I trying to sue the council cause thier white lines are slippery....NO. the chain of events started cause I was to busy waving & looking in my mirror to make sure the other rider had seen my jesture. Yes I crashed cause my tyre slipped on the line but all in all it was my fault & that is why I claimed on MY insurance, hopefully chill will get where I'm coming from[/b]

its pretty cut 'n' dried really ........ You have to prove negligience on the part if the council / motorway owner. They have more money than you for lawyers, who will argue that you are at fault...........its all a load of shit, if your brother or your Dad are solicitors, then take the case up.

If they are not, its a total WOFTAM. Mainly yours.

Good luck.

1. If it's a council hard hat, you may get something,

2. If its someone elses hard hat or other debris, your're screwed.

1. Its still going to be hard to sue but if you have the hat plus pictures you've won.

I believe the airport turnoff sign is quite visible, unless ur going a squillion miles per hour, and to not see a hard hat would be quite hard aswell? 8) 8)

But yeah, just take it as a learning experience.

i liked this answer best...
