There are several ways you can get stung for speeding and they include:
Laser
Radar
Speed Estimation
Follow and Time

Neka got done by a copper performing a follow and time and coppers are trained in performing this method of speed detection to eliminate all by the slightest in error.

The Police vehicle is placed behind the offending vehicle at a set distance. The copper then maintains this distance and follows the speeding vehicle for a set distance (normally 300m, but may be more, may be less). Provided the copper maintains his distance the speed will be accurate. Police vehicle have calibrated speedos.

If he went to court, at best he's going to get a couple of km/h knocked off. At 20 kays over the limit it's not going to make bugger all difference to the end outcome.

As I've already mentioned, the copper may just be sending the expiation notice out in the post because it was raining. If Neka is really lucky it will just be a caution and the copper is posting it to make him sweat. A very handy trick for teaching people to slow down and often better than whacking them with a fine!

Did you fine em for littering then.???... :)

I had a similar occurance a number of years ago, although I was issued the ticket. I took it to court, as it was crap, and won the case. The judge made the decision based on the conditions of the night (dark and raining), no hard data, ie camera / radar, and the officers incorrect report.

I also had an occasion when I was pulled over by an off duty cop who took my details then sent me a fine in the post... Overtaking on double yellows up the Bells line... Luckily he was in his own car and couldn't get me for speeding, but he had a good idea how fast I was going... :?

don't forget fellahs, in any matter before that comes before a Magistrate,he will *generally* place a greater 'weight' upon the evidence provided by the copper, than that offered by the long-haired leaping gnome in the box...

its because of the Oath that coppers take, and the fact that Magistrates need to trust someone other than the accused........there will always be the odd exception to the rule (usually because of sloppy paperwork on the part of the bronze.......)

Have appeared and represented myself on a *few* occasions.......

well excuse the expression, but......"Pigs Arse" !!

Got meself off *several* crook fines, got a couple of 'No Conviction Recorded', and once convinced a Magistrate to re-instate a licence that had been cancelled "At the Discretion of the Court".......ie gone forever (as I had been advised 2 years previously....)........He and I *argued* across a Courtroom for no less than 6 minutes, he eventually buckled when I refuted every case he made for not reinstating my licence....

".....Very well......Bailiff, Mr Gosling can have his car licence reinstated..........excuse me Your Worship, Mr Gosling has requested reinstatement of his motorcycle and Heavy Truck licence as well.........(growl) He can have any damn licence he wants !!! " ( actual transcription)

There were 2 coppers sitting in the back of the Courtroom that day, geez they gave me the hairy eyeball as I walked out.........wearing the biggest shit-eating grin you can imagine.....

Although these days I try to avoid the '3 name call' routine.......

Maybe go to court and say that because the rain was so bad that your concentration was on maintaining station with the vehicles around you.

Fark me Nath, with your luck, when YOUR boat comes in, you're likely to be at the friggin' airport !

Keep smiling mate (makes the buggers wonder what you've been up to )

its funny u say that..laying in bed last nite, it kept playing thru my head...
just before the tunnel (100 zone) i was sitting on 103-105.. a white commodore came hooting up behind me..i gassed it up a lil ..it was pissing down, the white lines were slippery & i thought he was gunna ass end me...i held my line & accelerated a touch...then, i looked back & he was gone...just before the end of the tunnel (how long is the tunnel??) as the roads were drier in there, i looked left & merged..still no cop...about 2-300m out of the tunnel i looked in the mirror and there he was..a grey commodore with the lights on...
yea it was pissing down, i WAS concerntrating on not getting cleaned up, and wot was in front of me....as im ussually pretty observant, i dont kno how i didnt see him behind me...nor do i kno where he came from...

i kno both me & my gf are alive..and i was safe and in no way endangering ne1 else....i was riding in a protective & defensive manner.....

im just pissed such a small indiscretion could cost me so badly...if i was doing 130 or sumthin, then i would kick my own ass...

You'll only get a summons if you got arrested or reported.... all you can do is wait and see what is on the fine when/if it arrives.

You sure you saw him write it out?

a little story that might give you some hope.

late one night returning home from my ex's place at about 2am, it was raining a bit.
i was in my dad's sonata doin about 140 down milliara rd in avondale heights. (yes they do get up to 140). i slowed for a red light at keilor-park drive, no-one coming, so i took off. back up to 140ish.
i see someone gaining on me so i gass it more. by the way milliara rd is a 60 zone. get down to the lights for the on-ramp to the calder towards the city and home. this guy pulls up behind me.
i take no notice and scream off.

on come the dreaded lights and he pulls me over under the tulla overpass so we're outta the rain. he wasn't even unmarked!

senior constable whatever asks me how fast i was going and where i was and where i was going, yadda yadda yadda. i say i dunno, gf's and home.

then he says. "i was trying to catch you on millara but i was doin 100 and it was too fast" "you'll get a letter in the mail"

"what have i been booked for?" i ask
"125 in a 100 zone"

i waited and waited and waited and never got a ticket.

but i don't speed on milliara anymore.
There he goes. One of God's own prototypes. Some kind of high powered mutant never even considered for mass production. Too weird to live, and too rare to die.
