hey mate, getting money outta the council is like pulling teeth!
However if you are an illegal immigrant, have 15 dependants, 7 pitbulls and a dead roo, then you may qualify not only for the repairs to your bike but also 3 houses in Footscray, a brand new ute and $2,000 each week!

Bahahahah it's so true.

My mum tried to make a go of it after separating from my father - she had not been in the work force for 30+ years. She tried for a while but couldn't cope with computer, etc on a couple of jobs and then wasn't physically up to the final job and ended up doing herself injury.

The government won't give her a cent....

... yet some fucking yobbo who has never worked his day in his life can still afford piss and tattoos and a piece of 2x4 to hit his missus with.

Oh and ironically if she hadn't tried to do it on her own, and been paid a couple of times during that period, then she would have qualified for a substantial "widower" benefit (for widows and those who separate after an extensive time out of the workforce).

And mate about the hard hat.. you have to prove it fell off a council truck (eg. has to have 'blah blah city council' written on it) or that the council knew it was there and failed to remove the hazard in a reasonable amount of time. Face it... you crashed because you didn't see something on the road and/or didn't react appropriately when you did. It sucks but it's not the council's fault...

it wasn't a flourescent witches hat mate.

if u's all read carefully... it was a HARD HAT. the 1's that construction people use.
white hard hat... those turn offs are marked with a lotta white paintings and also white lil bump's with light reflectors.


Oops... i did read it... but my brain said there was no way a hard hat would be on the road.....

Does it have the council's name on it?

It just so happens that one of my duties now as a technical officer for council is insurance claim investigation. If you are in brisbane (I don't know cause you are very vague about your location in your siggy thing m8...Australia is a big place) I gather you were on the Gateway motorway? if you were, council won't give a shit cause it ain't our road m8, it belongs to main roads dept. so you will have to chase them but good fucking luck. also like shifty said you will have to prove that it was their hat or that they knew it was there & didn't give a shit about moving it, it also wasn't impeding the major flow of traffic as it was on the side of the road. Last time I checked , hard hats are white, yellow, red or orange, the reason for this is so they are HIGHLY VISABLE, whether they be upside down or the right way up. This may sound harsh but at some point you've got to accept responsability for your own actions. I have no problem telling our insurers to "pay the man" if it's our fuck up, hey it don't come out of my pocket so to speak, but lets recap our story
(A) you were riding along in a day dream or whatever & missed your turn off
(B) Once you've realised this you went holy shit & pulled over to the side of the road & were to preoccupied with "how the hell am I gunna get back there without a 10klm detour" to watch where you were going or what was in front of you. It's a hard hat m8, they're relatively easy to see.

Sorry if this pisses you off, but if you saw some of the dribble I have to investigate you'd understand, eg. i had to look at 1 today for a young bloke thats trying to sue $4000 worth of damage from hitting a keep left sign on a traffic island.....W.T.F. is he doing driving on the traffic island? give him benefit of the doubt & go out to location, once i get there , there's a massive burnout from the intersection right up the road to where he lost it & ended up on the traffic island :roll: At some point you yourself are accountable, we are getting to much like America if you ask me, I don't mean this to sound like a reving, but you have to look at it from both sides :wink:

The Risk Assessment Officer from the Council (which is generaly a fairly high position) will take the RISK that you make the ASSESSMENT that you won't follow through with the claim cos it's a pain in the ASS...

But having said that... they will normally pay if you have a decent case. Just havta wait till ya grandchildren are due for their pensions to recoup the money...

Sorry to hear about the bike and good to hear you are ok, but fuck me, how the hell did ya not see a fuckin hard hat?

i got a hole in my radiator once because some council roadworkers shoveled hotmix and stones into the middle of a main road when the lights went red. this was in the middle of traffic and there was no signage or any kind of real warning that i was about to drive over roadworks. all that crap flung up into my radiator and next thing i know there is a cloud of steam coming out from under my dash :evil:

anyway, i'd say that's a case of it really being the council's fault. i got another radiator for $50, so that plus the pain in the ass trip home, the trip to pick up the radiator, installing it, getting new coolant, and cleaning the shit off my bike wasn't so bad. in the end i cbf going to all the effort to get compensated by the council.

as for the hard hat, well u rode into it when it was easily avoidable... sure u want money, but it will have to come out of your own pocket in this case. the damage was really minor anyway, just live with it :D

M8, never doubted you that it was there, what I said was that you would have to prove that they (they being main roads) knew it was there & did nothing about it, I also said that YOU were'nt watching where you were going. I'll give you an example, your riding along minding your own business & the fukwit in front of you all of a sudden decides fuk me, i need fuel, slams on the brakes, doesn't indicate & tries to pull into the servo driveway but overshoots it & stops dead. you have nowhere to go except into his boot or lowside it. either option ya bikes fucked. you try & claim & the insurance tells you to fuk off cause you weren't riding with the mindset of "what if this were to happen", "you must have been following too closely" It's classed as a hazard m8. Lets see now, do you have a witness, did someone see you drop it & pull over & offer up their details & say they are prepared to give you a stat. declaration & go to court on your behalf if it gets to that? Trust me, they WILL go to court if they don't think they have to pay, Main roads & the councils budget for court costs is bigger than yours. Prove to me that you didn't just pull the hard hat out of your gearsack or whatever, throw it on the deck & take some photo's...these are the sort of things that they will be asking themselves b4 they even think about giving you a cent. Trust me m8, I'm not being a smartass, I'm being realistic & trying to save you alot of hassle & heartache for no reason. Lets recap again.....it was on the Side of the road, YOU were trying to slow down, more than likely quite quickly, YOU were in charge of the vehicle, the hard hat was STATIONARY, YOU steered the vehicle into the object, YOU lost control of the vehicle & dropped it. Now had the hard hat flown off the back of a truck, ute etc., come flying at your head at 100k's an hour, you took evassive action & dropped it, no worries PAY THE MAN & APOLOGIZE SINCERLY FOR ANY INCONVIENIENCE, although it would be the ute or truck owners insurance paying. May I remind you that in the traffic laws state that person in charge of the vehicle is responsable for their own load or any article carried on said vehicle, you drop diesel all over the road m8 & sure we come & clean it up, but we then send YOU the bill for the clean up. you are responsable to remove anything that falls off of your vehicle so it doesn't create a hazard for other motorists. See what I'm saying, it wasn't the road shoulder, the road, or any of Main roads assets that caused you to drop it. YOU dropped it 'cause YOU steered it into the hard hat that was an avoidable HAZARD on the SIDE of the road. We all make mistakes & fuk up from time to time m8, it's human nature, the difference is that some of us are willing to accept the fact that we fuked up, while others are prepared to do whatever they can to blame somone else for THEIR actions. M8 they will look at your claim & your quotes, find out if your insured, & if your not go, YEAH RIGHT :roll:
