Except of course it no longer complies with the current emission laws. However misguided they are, they are there for a reason - just look at the air around Melbourne and Sydney on a hot still day. And if you think that's bad check out the air in Los Angeles or Mexico City.
I would think if you're pulled over by a half-savvy copper or the EPA you will be either be charged with breaking said emissions laws, and at the
very least sent off for testing at the EPA.
I'm not a copper, and couldn't tell you the fine, but any fine is bad, and the air quality in our major cities
